Depends upon the phone you have.
Its usually pre installed or available via your phone manufacturers store app .

You can have an Android phone without Google Play, lots of cheap Chinese one are like that, the Kindles are, as is the Nokia X0

Looking on google, it appears I need ios7, I currently have ios6, and from what I can see, ios7 is not available for 3gs
