National Express Coaches, Refunds and false Tracking

Luckily for those of us that live in the UK we're able to pop into any law firm and ask for their advice before preceding. For this small sum none will take it, but for the principle of the matter I'm sure a lot will - I'm only going to bother if my case is a sure win, and I think it is. So the total will be 1 day off work, 1 solicitor etc
You are aware that you cannot claim back those expenses at small claims?0 -
Out of interest how do you know that the coach left 8 minutes early, as you weren't there (obviously)?0

What phone by default records for your viewing please the transmitters that were nearest the phone.
And how does that prove you were at the stop. Sorry, it just can not be that precise. You could have been in Wetherspoons 20 yards away for that data proves.0 -
It didn't leave at 10.55. That is the point.
But National Express claim that it left on time - not early, not late - on time. That is the point. The OP wasn't there when it did leave so how does he know when it left. Does he therefore have a witness who can corroborate his version of events.0 -

If, as the OP states, they are going to attempt legal action over this, then they will have to state how they are aware that the coach left 8 minutes early.
Considering that in their opening post they stated that they arrived at the departure point 6 minutes before the due departure time, this 8 minutes early estimate could be impossible to explain.National express customer service is a joke! I phoned them asking for a refund for a coach that left its stop 8 minutes early, . I was at the bus stop waiting 6 minutes before time and left 30 mins later.

Look I don't care about this one way or the other. But if the OP is riled up enough and has got the free time, it's easy enough to start the small claim process.
If his cell phone tracking can prove he was there eight minutes before the off ......... and I've no idea if it can, small claims work on who's believed and probability. As I said, if the phone can prove he was there six or eight minutes before the off, why would he not board his coach (if it was there to board) for the pleasure of going to the small claims court for a refund ?
Plus Nat Express would settle beforehand because none of this would be worth their while.0 -
BoP interprets for the hard of reading.
OP wanted to catch a bus to go somewhere, but unfortunately, the bus left without them. He huffed and puffed, and even had some tracking device on his phone to prove, as if by magic, he was somewhere.
Bus company in TnCs says you had to be there ten minutes earlier, and their bus whizzed past the bus stop.
OP has been to see some learned friend. They gave him short thrift. The same has happened in this parish0 -

Exactly my point, and one which Somerset fails to grasp. Mynameisdave is also correct in stating that cell phone proof of being in the vicinity does not equate to proof that he was actually standing at the departure point. Anyone who has commuted will have seen people clutching cups of coffee/newspapers running up to the doors of trains just as they are closing because they thought they had the time to make their purchase and still make it on time. I've done it myself!
All pretty much irrelevant as 1) the OP is unlikely to return and actually answer the question about the departure time, and 2) is unlikely to take this to small claims.0
