Sorry that you are in this difficult position.
If the contract is frustrated, then you no longer have the obligation to pay rent and are free to find your new home.
Your landlord will have to claim on his own building insurance to sort the place out and that is a matter for him. You will need to claim on your contents insurance for any damage to your own property.
You should also arrange for the retrieval of your belongings from the rental property as that is no longer your home.
The matter for debate is the return of your rental deposit, given that the property is damaged. If it is agreed that the damage to the property was not your fault, then the check out inspection should ignore any directly caused damage.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. You are in a very strong position.
Clearly your landlord does not have 'landlords insurance', but normal domestic insurance. If the insurers find out the owner has been letting the property to tenants, they will invalidate the insurance and not pay out. A bean.
You could ... ehem!... request all sorts of compensation in return for your.... ehem!.... silence.
The Insurers will work out it's a let property without the need to grass the landlord up. It's not difficult to see they're tenants, a check of the electoral roll and credit check will have already flagged this up.
Insurers are not as stupid as people assume and they always investigate fire claims to ensure everything is in order.0 -
