    It makes it worse to me that they spent all evening sorting out a kitchen for no discount while their son was waiting to cut his cake.

    I dont know why you are hung up about the birthday, and why make so many assumptions? where did the OP say the son was waiting to cut a cake

    so many new posters get ridiculed and then disappear. I wonder why

    Are you willing to admit that you saying that the OP was given a 20% discount because of their son's birthday was simply a figment of your imagination?

    OP in a nutshell, if the terms say you wouldnt be able to cancel without being liable for costs due to breach of contract, then neither can they. In order for a contract to be balanced, it needs to be equally binding on both parties.

    Yes you could technically try to ensure they uphold what was agreed, but given the posts about howdens etc, it may be worthwhile getting quotes from elsewhere and getting recommendations from friends/family.

    As for those shocked at the bday issue.....I wonder what your thoughts are on those who don't make a big deal/celebrate birthdays. And given son was at home, i think its safe to assume he's at least a teenager or was home with friends/family.

    Op if your not put off by now and ever come back to this thread then it's called "offer and acceptance" and "loss of bargain".

    It looks to me that offer and acceptance took place, with the paid deposit as proof.

    Any representative that is selling you a kitchen on behalf of a merchant can enter into a contract with you regardless of what the manager says, if they said 20% discount and it's what is agreed then the contract is concluded. If the manager disagrees then the salesman is to blame and they need to take the hit not you, that's an internal matter.

    The problem you have is it can be a hard case to prove but you certainly have a good chance. You have to go out and find the same items that match what was ordered to the best and cheapest merchant either the same or as close as possible, if the difference is more than £200 you would then just have to pay the difference to B&Q under protest then take them to the small claims court.

    The threat alone by LBA may be enough for a more senior manager to pay out as it looks like you have a case.

    Hi everyone.
    Thanks for the responses, even though most of them were about my son's birthday. :)
    As we are all involved in this birthday, can you ALL send him birthday wishes?
    His name is Danyal and he just turned 10.

    Like i said we didnt expect the meeting at B&Q to last more than 30-45min. max 1 hour.
    BUT they have Pentium 3 PCs to design the kitchens, anyone a little computer literate will now understand why it took 4hrs. :)

    OK. Spoke to Deputy manager today... who said he will investigate. This was at 10:30am. Nothing happened, so the wife went into the store after picking up our boy from School.
    They more or less said the same. They will only deliver if we pay the extra.
    She then asked to write on the store receipt "Payment under protest" but they wouldn't let her.
    She asked for the manager again, but apparently they both had gone home in the space of 5min at 3:30pm.

    She asked for another manager, who said "its my 1st day, but I'll investigate and get back to you 1st thing in the morning"
    So we haven't paid.

    Spoke to the CAB, they said this should be an open and shut case... they entered into a contract and they must deliver, if they cancel the agreement and back out from selling to us, then we can "loss of bargain" claim.

    Just a few minutes ago my wife got a phone call from the Executive office of B&Q and he wanted to know the whole story with names of people involved, and he said he will deal with it in the next 30min.

    If i have to I will take it to a small claims court. Enough is enough of these huge corporations just taking the p@!s
    I know its £350, and honestly if they spoke with some decency and manners I would have paid it.
    But from stage 1 they have accused us of lying.

    Anyway guys thanks for the feedback, and pls dont forget the birthday wishes. ;)

    oh by the way, my boy was at home with his grandmother, grandfather auntie, uncle and 3 cousins.
    His birthday was promised for Saturday, but we did arrive VERY late to cut his cake.

    Will never let a kitchen come between us ever again. ;)
