Can a Rental Company FORCE You to Use their SunPass?

A car rental company has all their cars fitted with SunPass for toll roads in America. Can the company say:

"You will be charged at $5 a day for the use of a SunPass"

... even if I choose to use the cash lanes, thereby not even using the SunPass, OR don't travel on the toll roads?

They can't force you to use it, but they can force you to pay for it.

A couple of times we have had cars with Sun Pass etc. installed in them We just say we don't want it, make sure we havn't signed for it and turn it off. They are usually situated at the top of the windscreen.

I usually use Avis, Hertz or Alamo (depending on which had the best deal at the time). Of these three Avis is the only one with a Sunpass transponder in the car while Hertz and Alamo use "toll by plate" number plate recognition system if you choose not to use the cash tolls.

The Avis cars have the Sunpass fitted to the windsceen near the rear view mirror. They look like this:

and it's a simple 1 second job to just switch it off.

We had our own Sun Pass as we were often in Florida. We just said no to the rental company.

Hmm, I will have to contact the rental company as they are telling me I must pay for it... even if it isn't used :S
