    I am sure we've had people complain to Threadneedle before, certainly don't be put off by the fact these landowners of retail space are large corporate bodies as we've seen that sort of organisation tell a PPC to get stuffed on more than one occasion. The fact is (and this should form your complaint) that if ParkingEye had told you clearly that receipts over £30 would have meant they could have cancelled this as you were exempt as a paying customer, you'd have shown your receipts to PE or the Store Manager and got it sorted wouldn't you? But you had no idea PE were suing people nor that you could have claimed a 'genuine customer exemption' because PE don't tell people - so you ignored their fake PCN (following old Watchdog advice) and feel more than aggrieved about this horrendous harassment of a customer. State clearly at the end of your complaint what you would like the landowner/managing agent to do about it and that you are not happy to pay Parking Eye a penny under these circumstances of threats and misinformation.

  • the court has acknowledged intention to defend and now we have a 52 page bumper pack of words. it says they intend to proceed and lists a plethora of reasons why they think they will win....

    ok , so you now have the standard response designed to frighten you into submission

    just treat it the same way as all the other advice to similar MCOL claims on here

    yet no mention as yet of a landowner complaint or cancellation despite it marching on

    if its too much to deal with , maybe let parkingticketappeals.org advise you on your defences ?

    i do admit. simply paying and then hoping for a freak yachting accident to the people in parking eye, is tempting.

    my point was , what else did you expect ? they are following a well trodden path here and you should have known this was coming and looked up the next stage once it had happened

    post #5 of the NEWBIES thread + parking pranksters PE guides tell you the processes involved AFAIK , so being prepared is one of them

    another is cancellation by the landowner which yet again you appear to have overlooked (not mentioned yet again despite my prodding and others prodding)

    surely if you get a cancellation by the landowner then the MCOL will fail, did you not get that from previous posts because I certainly did

    its also a feature in this thread here about PE too

    What? Sorry...I don't understand your post. You can't 'appeal' to the court and mediation isn't a box you would want to tick...do you mean asking for POPLA? Well yes - after all that is covered in the sticky thread post #5 and comes later on after the N180 (which you will already know about from reading the links in the newbies thread).

    We are more interested in knowing whether you've gone full throttle for a landowner complaint and what they said?

  • things not going well this end. very poor internet connection. a dead computer and finally reconnected.

    i have done little in the chasing down of the land owners due to being in France and trying to sort things out this far away is proving difficult.

    i did mean asking for POPLA.

    And if not agreed to be stayed for POPLA, ask for a stay for the outcome of the ParkingEye v Beavis case that you will need to get up to speed with. Search the forum for 'Beavis' to read loads about that case going to the CoA in Feb 2015. People with a PE claim now, should get their PE cases stayed but you must be assertive and ask your local court in writing, with detail about the Beavis case (they won't know).

    Hope you are following all the other court cases on this forum as you can learn from their defences & outcomes. liseylou and 45mip19lot have hearings v ParkingEye coming up later this month, for example, which I really hope you know seeing as it merely takes a search of the words 'ParkingEye Court' (ParkingEye being ONE word or it won't work well).

    And here is a new poster who tried asking the court for a stay for POPLA and didn't get it agreed:

    That happens a lot but doesn't stop her then asking for a stay for the outcome of the PE v Beavis CoA decision instead, if the Judge is minded to grant an order for that.

    HTH - nothing to lose by complaining and certainly by turning up if your court press ahead with the Hearing and don't agree to your request for the case to be stayed. Which is your next course of action as per post #19 above and as per all the other threads like yours (details of what to say in a letter to the Court is as shown in post #5 of the Newbies thread).
