cp plus

I got a parking ticket back in april for not displaying a vaild parking permit in a railway station car park. I appealed the ticket under the grounds of poor signage no entrance or exit signs stating it was a pay an display car park, but this was rejected stating bylaws. I have since recieved a letter from debt recovery plus and was wondering what i should do next can i ignore it or should i pay up. I have contacted the landowner south west trains but to no avail. Popla cant be involved because of the bylaws and the bpa cant help either. Many thanks for any help.

    You can safely ignore the debt collectors as they are toothless no matter what they tell you.

    I'm not sure about the rest, but there may be something in the Sticky thread for Newbies at the top of the page to help you.

    Was this a windscreen ticket or did you wait for a notice to keeper.
    Which PPC? ( Was it NCP?). Did they issue a POPLA code?

    Thanks for your answers. It was a windscreen ticket, their was no notice to keeper. I wasnt issued a popla code because of bylaws. The company is cp plus

    I suspect that is a Load of old bunkum, but I am not fully conversant with bye laws etc yet. Let a more experienced forum member give advice on this. I expect an email complaint to BPA is in order.
    Bye laws usually mean no keeper liability, not no POPLA.

    Oh and ignore DRP,letters is correct advice at this stage, but I think we should be getting you to popla. CP. Plus have ever done court, so these letters will all be hot air. You can ignore them forever! Unless should the earth move in such a way that you are the first to get an LBCC from CP Plus (not DRP, zenith or whoever)

    Do you have rejection letter still? If so can you put a copy on here in case needed?
    Use tinypic or so,e other free photo hosting service and post link minus the http:// as you are a new user.

    If you search this forum for 'CP Plus station penalty' as keywords, then you should find plenty of other cases talking about these hybrid 'PCNs' which do include the word penalty. CP Plus issue them under the guise of the railway byelaws and don't offer POPLA, as you have found out.

    If you didn't actually pay the P&D fee then technically, as long as the byelaws offences were clearly displayed (and you say they were not) this *could* be taken up by the TOC (train operating co) as a real penalty and enforced.

    But:

    - the TOC only have six months altogether to 'lay' the case for Magistrates court
    - three months has already passed and CP Plus are doing their usual debt collector drivel
    - I am not aware of ANY of these going back to the TOC
    - I would say it's likely to continue wih the usual DRP and Zenith letters which you can ignore
    - If it were me I would diarise the 6 months from the PCN then you know that it cannot be pursued in any way (neither Mag's Court nor County Court would be applicable, as CP Plus mess the situation up in the hope people just pay).

    If you were my relative I would say to ignore it - but be more careful next time, as on railway land a firm like CP Plus could have clamped you in fact, for a byelaw breach!

    I would not pay. I would collect the letters and be grateful that all the time it's with debt collectors, it's not being enforced by the TOC!

    Just to confirm that as this was a debt collector letter, not a letter from the PPC or their solicitors the advice is to continue to ignore. Six months are getting nearer now.
