please help. phone contract wrangle!!

just got a new contract with Orange, and a k810i. The phone broke (it kept freezing, craching, turned itself off after receiving message etc...) so the sent me a replacement and it was exactly the same. So, today they are sending my another. I noted to them that i was out of my 14 day return (i've had the phone 4 weeks), but stressed i wasnt really happy with the phones that they were sending me (they were all broke) and asked if it were possible for me to pay for another one. She said it would be like an upgrade so would cost alot, however, after she ordered my replacement she said "we'll see what happens to the third one, and if that doesnt work we'll maybe see about sorting you out another."
Now, i've heard in the past that if a service fails 3 times or more (with the same issue) you are entitled to return it mid term. Is this correct? What grounds do i have?

If your phone fails for the 3rd time, Orange will usually offer to replace it with a different model of similar or lower spec. They give you three choices.
Also each time you have your phone replaced, it's with a refurbished model, so a phone thats been returned and then repaired which is why it still may be faulty0
