Waiting on a response to my appeal but I sent McDonalds themselves an email via their Contact US page on their website. So far I've had no response does anyone know of an email address I can send a complaint to again for them to get back to me on?0

Nope it's pointless contacting McD's Head Office. The only worthwhile complaint would be to the Manager on site, as is shown here in the successes:

Look at post #2 for examples of a McD Manager making a phone call to cancel a MET PCN. There are no examples of McD Head Office stepping in, because they don't, not even the CEO.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok as expected my appeal to MET has been denied.
What do I need to do now to make this water-tight?0 -
a popla code and a good read of post #3 of the newbies sticky thread (which you should have been doing ever since you sent MET the template letter)
a popla appeal is similar to the template letter but much more detailed , plenty of examples from that post #30 -
Thanks Redx. I've been having a good read through and its alot of information to take in and try to work out the best points of appeal.
I know ANPR has to be in there as that was used. But I'm not sure on all the points of POFA and the BPA Code of practice and whether the NTK sticks to everything it should. Also my appeal response from MET mentions including information but it actually isnt with the letter?0 -
just add all the relevant legal arguments, dont start to take apart your own appeal
you want everything listed in the template letter and probably more besides
if MET havent given you a popla code, complain to the BPA as per post #6 of the newbies thread , also writing back mentioning this breach of the BPA CoP and 2014 newsletter in not providing the popla code
but double check all paperwork for that all important 10 digit verification code
then start drafting the popla appeal in notepad , dont keep leaving it like you have done so far, do the research and cobble a draft together, with between 4 and 7 appeal points, then hone it
personally, I would find a recently approved popla appeal against MET or a similar car park issue and adapt it (maybe another mickey dees appeal ?)

Ok drafted up most of the popla appeal. I'm really not sure whether I can include
[FONT="]3. Notice to Keeper not properly given under POFA 2012 – no keeper liability.[/FONT]
since I am not actually sure if it is breaking the rules or not. For a newbie it is not actually that easy to work out all the in's and outs of whether a notice is compliant or not.
Also very unsure about what to put in for:
[FONT="]5. Unclear and non-compliant signage, forming no contract with drivers.[/FONT]
As the car park in question is over 100 miles away from my home I cant check the signage but there certainly wasnt anything on entry. Ive seen a good response here - forums.moneysavingexpert.com/showthread.php?p=65877901#post65877901 but I'm not sure how relevant it is to my case (obviously not the bits about lay-bys and signs for it etc).
For newbies the POPLA stage is actually extremely confusing and there are so many links that say "include this in appeals" all with different wording that it makes it very difficult to actually piece together an appeal without repeating yourself.
I really don't want to get this wrong and fail hence why I am here asking the questions to make this successful.
If it helps I can scan the NTK and scrub the personal info off so the experts here can advise me accordingly.0 -
Don't worry about this.
Just put the PPC to strict proof that their paperwork, signage, ANPR system etc, etc meets with requirements. And to be frank, if you've got the correct no GPEOL argument in there, then you're more than half way to winning.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
