Neighbour hit my parked car, says I can't do anything about it

    Why else would you want their insurance information, if it was not for a "claim"?

    A 'person against whom a claim is made' is required to provide insurance information but I'm asking if a claim has been 'made' at the time immediately after the collision, of if it is considered 'made' once it has been reported to police/insurer/mib.

    If it's only considered 'made' once reported to insurers/etc then there's no requirement to provide the information to the driver at the scene.

  • Your insurer still needs to know

    Even when claiming directly against the other party, your premiums still go up

    You still need to disclose this incident to any other insurer when getting a quote in the future

    Oh i agree, i just meant you wouldnt have a 'claim' with your insurer, always need to notify

    A claim is made at the point when the person to whom the claim is being made becomes aware of it. (A claim in this sense is the broad claim of liability, rather than a specific insurance claim).

    Depending on the scenario, that could be at the roadside, or it could be elsewhere at a later time.

    Had you blocked the drive he would not have attempted to reverse out, he would have had to get you to move first. As he could get out but failed to do it properly then he is at fault because he was in charge of the vehicle at the time.
