Hi,
If someone could please have a look at my previous Post #31 - POPLA Appeal Draft 03 & tell me if that'll do as my POPLA appeal or if there is anything else I should add, it'd be much appreciated.
I'm in a bit of a rush as I only have until 12/08/14 to appeal, that's next Tuesday, & I'm a complete newb.
All help & assistance is greatly appreciated.

It's long, but hey I think you can go with it. It certainly contains lots of points. I have only ski. Read it so make sure it is the same PPC mentioned throughout as when you copy and paste from other appeals. You've got a week to submit this but want an almost instant response (within 3 hours of posting) to a 'War and Peace' appeal from over-stretched regulars who've been inundated today with 'heeeeelp I've got a PCN' posts!
Can I ask, have you read through all the details, and understood all the significance and implications of the following?This is most clearly stated in Lordsvale Finance Plc v Bank of Zambia [1996] QB 752, quoted approvingly at paragraph 15 in Cine Bes Filmcilik Ve Yapimcilik & Anor v United International Pictures & Ors [2003] EWHC Civ 1669 when Coleman J states a clause should not be struck down as a penalty, “if the increase could in the circumstances be explained as commercially justifiable, provided always that its dominant purpose was not to deter the other party from breach”.

NOT the first picture which shows a sign above a car - doesn't help you as much at all. But your POPLA appeal now includes everything that usually wins, so go for it!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
