Why do PPCs persist with all caps signs?
It was one of Martin Cutt's points that they are harder read and so make it hoarder to argue that a contract has been formed, you would have thought it would be a easy gain for them.
I guess most of them never got on to joined up writing.0 -
And this:-
Stephen Hall asked for a gagging condition on paying the defendant's expenses, but Judge Birkby informed him the case was in the public domain.
Why on earth did Hall think the judge would ever comply with his request? What have UKCPS got to hide? What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
The "walking off site" bit is pure nonsense . Does it apply to both the driver and any passengers? what if just one passenger leaves site but the driver goes into the shops on site. What if the driver just wants to leave site for a minute of so to go to a cash machine across the road?
Then you have the twelve year-old child rule. Have UKCPS got some mechanism for determining the age of a child? What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

I can just see this in front of a judge:
"The driver did not walk off-site, the driver remained in the vehicle the whole time."
"Yes but the passenger walked off-site."
"So sue the passenger then. Oh, you can't, because the passenger didn't enter into any contract."
Case dismissed.Je suis Charlie.0 -

They could use the ridiculous system an "Eat As Much As You Like" restaurant has near me - if you're 12 or over you pay full price for the set menu. How do they decide if you're 12 ? They measure your height !!!!"The darkest places in hell are reserved for those who maintain their neutrality in times of moral crisis." - Dante Alighieri0 -

Really like DJ Birkby's style at Sheffield, what with this case and the other ParkingEye one I linked above where the defendant didn't even need to speak!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Oor Trev's currently working on one of his mathematical angryrythms for this; be patient! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
