Hi guys

I had two replies from members of the forum, hoohoo and Dee140157 seems to be conflicting as hoohoo advised me to contact BPA and D140157 said my appeal was late.

So I am not sure what the way forward is .

To clarify you originally ignored the PCN and this was an attempt to appeal a PCN that was past the time allowed. This has been refused. They are within their legal rights to do this, although morally we disagree.

They haven't broken the BPA code of practice by not offering a POPLA code, although there is no time limit on which they can issue it if they wish.

So complaining to the BPA is not really the right advice here.

Sadly it may be a case of ignoring the debt collectors letters for the time being.

Only if you get an LBA/LBCC/MCOL should you worry and then come back to is for advice on how to bear that.

The fact that you have tried to appeal will be of benefit should it go to court.



Have you actually told us which the original PPC was thatnewlyns are acting on behalf of?

They are acting on behalf of excel and I don't know if it is advisable to
contact the car park owners who are my employers at this stage or it is too late.

you didnt appeal in time so the BPA are going to side with Excel and you have no grounds to appeal this to the BPA that I know of

it should have been appealed within 28 days of the ntk, thats a fact and in not doing so you caused this stalemate

so I also agree with this quote

there is no "magic wand" solution and this can drag on for years, 6 years to be pedantic about it

My car is registered at the car park, I was parked beyond the lines as the parking bays were full and the original parking ticket was for £40 and now it has rocketed to £166.00.

May I contact the car park owners or not?

my post #25 tells you all you needed to know

by all means contact the landowners if you can get them to cancel it

just dont expect this to be easy , easy was appealing to popla in good time and winning , that ship seems to have sailed

there is nothing else to be done, as unless you actually pay up you are in debt collector territory, and then possible small claims court

The car park owners ARE the only person who can cancel the ticket now.

We have suggested several times to read Newbie thread thoroughly and it does tell you to complain to the landowners to see if you can get it cancelled.

This is currently your only hope at this stage. The next will be a LBCC/MCOL in which case you will need to put in a court defence.

Just to clarify, this is Excel from who court cases are rare (but not unheard of).

Have you complained to your employers? Should've been your first port of call. Are you in a union? If so, get them involved.

And if I were you (effectively penalised by my employers just for doing my best to get to work) I'd start looking for a new job.
