issued with a pcn at the hospital where i work

Hi guys

I need some advice here because I was issued with PCN on the 11.3.14 for contravening code 86, parked beyond bay markings it reads time seen 10:01 hrs and time issued 10.17 hrs (filmed). I asked work colleagues and they advised me to ignore it as its a private parking and my car is registered for parking there.

On the 15.04.14 I received another letter from excel parking now demanding 100 pounds or 40 if paid within 28 days. I was advised to write an e mail to newlyn and Wrote them an e mail and they did not reply.

Now they have send me court action pending for me to pay 166 pounds within 14 days or they will be ccj and bailiffs will come.

So what can I do now help.

First if all tell the people who told you to ignore that this was bad advice

Secondly Newlyns is a debt collecting company. They cannot take you to court only the Parking Company can. Nor can they send the bailiffs around. That is hot air.

Now go to the newbie thread at top of page and read it, focussing on post 5 especially. Read it a couple times then come back and ask further questions if you do not understand something. Follow the advice in the thread.

What parking company is it and have you complained to the hospital?

right at the top of this forum, just below the green banner , its "stuck" to the top of the forum so people can easily find it (top of page one)

ignore NEWLYN and only deal with excel

tell your "work colleagues" they should pay this due to giving you bad legal advice

send the template appeal to excel asap

I had exactly the same and ignored all letters. After six months they stopped coming. This was now over a year ago. There are many posts on other forums that say do not contact for appeal or whatever reason the issuing company. Those who say contact them are giving very poor advice.

The next letter you get will say they have spoken with their client and have reduced the £166.00 to, let's say, £125.00. Ignore.

I know exactly what it is like when you receive one of these letters. You feel downhearted. File it away and dont read it again and get on with your life.

Please please please ignore Revengant. He is totally wrong. If for example the PPC is Parking Eye they are very litigious and take a lot of people to court.

It has not been advisable to ignore a PCN since Pofa12 came into existence.

Revengant do not put bad advice on this forum. You know nothing.

for england and wales this is terrible advice

if you (or anybody else) checks the small claims website (or MCOL) you would know that they can pursue invoices for up to 6 years , so 1 year is one-sixth of the time so dont think its clever that you have heard nothing for a year, come back in another 5 years crowing about it !

at the moment some companies like CEL are going back 2 or 3 years with court cases and the debt collectors like DRP are sending out claims dating back 5.5 years

all anyone has to do is read the NEWBIES thread and follow the advice in there , so its best to strike while the iron is hot, not bury your head in the sand hoping the hungry lions wont see your bare a** sticking out like a sore thumb

the only thing worse than no advice is...................................BAD ADVICE!

Thanks some of the advice is misleading like what my mates told me. I send them an e mail from my workplace but they are persisting. I cant find an appeal with my scenario as I have recieved a letter from Newly threatening me with ccjs.
I have seen only one but the difference is that it was on a supermarket where as mine was at work on my work parking. Where do i direct the appeal excel or newly.

Will try to copy one and will post it so the forum might see if its worth sending to excel.
