If you are so used to signing papers, why have you been so reluctant to print a letter out and post it with your hand written signature on the bottom?
You've made a mountain out of nothing. You aren't dealing with a professional outfit, you are dealing with a company who knows all they have to do is randomly slap numbers into a telephone keypad and "viola!" the coins come rolling in.
They are well versed in dealing with people who threaten to go to Watchdog, FCA, Tesco, The Ninja Movement of Internet Securities and whoever else you feel you are going to use to shut them down.
We see repeated promises from people guaranteeing to shut them down but alas, they all fail. Mainly because they are the type of people who think a cold call brings good news.
It won't, but lets pretend it ever got to Court.
They called you and told you they are going to charge you a fee, you agreed (yes you did).
You decided it's isn't for you so you want a refund.
You write a letter requesting your refund (posted recorded delivery of course).
They refund you. If they don't, you lodge a complaint and then a formal complaint.
You then take use the FOS to put pressure on them because they haven't responded.
Thats it! no need to waste the courts time. The procedure is simple.
They didn't really guess your number though. You are on a list of people with bad credit and/or history of trying to grasp cash from anywhere. They sell these lists of likely [STRIKE]suckers [/STRIKE] customers so they can all have a piece of the pie.
I get lots of PPI calls but sadly, I have never had a cold call offering me a guaranteed loan, there must be a reason for this.0 -

the simple fact is that they were told that I did not wish to proceed and that they could not take any money. Four weeks later they took it.
I really do not care about the refund, it arrived in full today (no £5 fee), however I have looked on the audit behind the transaction from the Bank (Natwest are really good). this was not processed within any of the numerous time lines that I was given by the company. (it was done at 11am this tuesday).
My point is that they have a duty to address issues objectively, not call a customer a liar and hang up.
I have asked for an incident report, with outcome and lesson's learned. They can not have performed a credit check for affordabilty as they would have clearly seen that I did not require thier services.
The act of taking the money, when told that they can not take it (again being hung up on, when I said that I did not wish to proceed) is a criminal one, not an accident. This is an act of some litttle oik getting his commission.
I am entitled to take a prosecution against that person, however I wanted the give the company opportunity to show that they had addressed it fully and to an acceptable standard.
I would then have dropped it. One thing I will say, is allways tell them that you are recording the calls. I have had them say things that really drop them in it and also got them to agree to pay the charges that I have applied in time spent addressing the issue.
Surprising what they agree to when you can hear them take the head phones off and hear the office in the background instead!!0 -

Good night all, it's been a fun (wierd) day.
my first experience of posting anything on aforum proved to be alittle more surreal than I had initially expected.
But having been sat at this desk since 5.30 this morning, with only a flash of filter coffee and and couple of danish pastries, trying to buld an AD from scratch with corrupt source data, I think it's time to call it a day and head off home.
