mis-sold car?

Did you assume that the exact car you ordered had stop/start, or did the sales literature state it would? Was it from stock or a factory order?
Even if the brochure did, you'll find E&OE in the small print at the back - sometimes, cars come through that do differ from the intended spec, due to a glitch in the ordering/manufacturing. If it was from stock rather than special order, then you've got an extra variable - how long since manufacture?0 -
What exactly do you mean by this? Did you specify stop/start as an option? were you told the car your were getting did have this included?I bought a brand new car on 1st September 2013
when i purchased the car i was under the impression the car was fitted with stop/start technology. after test driving a car with it in, i was lead to believe the car i was buying was also fitted with it.(
Personally I think the offer is reasonable given that you've used the car for over 10 months.0 -
many thanks to everyone for your responses, the cost for a new one would be £6800, which i really don't have. i'm not overly bothered that the car doesn't have the stop start, its just that i was told when i bought it, that it did and the sales lady and i had lengthy conversations over it! . so i guess i was looking down the route of being 'miss sold' i have had some information from the citizen advice, and like a few of you have said because i took so long to take the car back, i have deemed to have accepted the fact that it didn't have the stop/start with it.
thanks again:T0 -
If you where informed by the dealer that your purchase had stop start then you do not have the goods you bought and have a valid claim under SOGA .
But my guess is that as its not on the order form its a case of you say she said >> she says <<oh no i did not say that .0
