mis-sold car?

I bought a brand new car on 1st September 2013
when i purchased the car i was under the impression the car was fitted with stop/start technology. after test driving a car with it in, i was lead to believe the car i was buying was also fitted with it. so much so after i drove my car out of the show room, the first thing i noticed was the car was not cutting out when it was supposed to. i contacted the garage a few days, maybe a week or so later, to ask why it wasn't working. i was advised it had to get used to my style of driving before it started to work. well 10 months and 5000 miles later the car is still not cutting out. i booked the car into the garage to have it looked at. when i went to collect the car, the reason the stop start wasn't working, was because the car was not fitted with it!!!
i would like to know where i stand with this? they will not fit the car with it as it will cost them too much money! the manager has said he will sell me a new car at cost price, or even make a loss if he has too, but they are only offering me £11,000 for my car that i paid £13,500. And they now seem to be back tracking slightly on what the initially said.
i do not have anything in writing about the spec of the car, only the fact that i test drove a different car with the stop start in, as they did not have the car i was buying, with that technology for me to try. my dad was with me when i purchased the car.
where do i stand? :(

    Unfortunately I think the offer you got from the dealership is the best you'll get. Does stop-start make that big a difference for you?

    Problem is that you must have known the spec of the car you were buying, at which point it would be pretty easy to find out if it had stop-start.

    The only recourse you'd have is if the dealership has confirmed in writing you would get stop-start.

    As for the test drive, that has little to do with the car you bought, after all, was the test drive car the same colour? Did it have the optional extra sat nav etc?

    Sounds like one to chalk up to a life lesson.

    Just as an experiment, do you have the air conditioning on high? If so, turn this down (or off).

    My Seat has stop-start but the VAG system has a huge list of conditions that must be met before the stop-start system will work:
    - The car must be up to temperature
    - The A/C can't be on too high
    - You can't be on too steep a gradient
    - You can't have the steering wheel turned beyond a certain point

    I'm sure there are others too. That said, the car will tell you on the screen if stop-start can't be activated.

    You test drove a car but did not order the exact same model is the usual story .>>

    The offer for your car is reasonable as its lost value from the moment it was registered and it also has lost the included VAT .

    The key question did you order this vehicle with Stop Start or did you just assume the vehicle you ordered had it fitted .
  • Seriously, move on with your life. Stop/start is really not important, it's not going to save you a fortune.

    Only reason I can see for swapping is if it makes a difference to the tax bracket. Stop start is a nifty way for manufacturers to drop the Co2 ratings, nothing more really so unless it is actually costing you anything then I would move on, especially if the car has been otherwise reliable.

    Also remember it is nothing at all to do with the value of the car it is just the cost to change. So if they are willing to give you 11k for your car and put you in a brand new one at cost price that doesn't sound like too bad a deal. What is it going to cost you for a (mildly) better spec and zero miles on a brand new motor? £500?

    Try getting that deal anywhere else.

    You would have had rights all that time ago - but its more than likely acceptance would be deemed to have occurred by now

    The first thing I do after starting my car is turn off the stop/start. It drives me mad in traffic or else I sit there with my foot on the clutch to stop it kicking in.

    If it bothers you that much take their offer for a new car. 1500 depreciation seems pretty good to me for a new car and is offset against any saving they offer you, or perhaps I just think that because I always lose a fortune on them :)
