Pay for the item with Paypal and that will stop a strike. You can report the seller for being a non-performing seller. You may find they just refund you, but if not you can open a case to get a refund.

If they send a request to cancel the transaction then you can say no. They'll still have to pay fees then.

You could just phone ebay and they should be able to resolve the situation.
I'd follow the first option and pay for the item, then put in a claim for a Paypal refund. You can prove payment, but the seller obviously will find it impossible to prove you have received the item(s)... so
    1]. they'll lose the case
    2]. you'll receive a full refund
3]. the non-payment case will be cancelled when you make the payment
4]. You can leave any feedback you choose
5] the buyer cannot have it removed since you paid for the item
6] the seller will be left with the 10% selling fees
7] they're £10 worse off because of all their antics! And you've lost nothing! :)

^^ This is what I would do.

Yes definitely do as per the two posts above; it will protect your Ebay account and you will not lose your £100

    Hi
    Thanks for all your replies.

Unfortunately I was taken ill and so didn't ring ebay or defend the Non payment case, so I thought that's it !

But there is something I don't understand. The seller closed the case, but the. Opened a case for me to agree to the cancelling of the purchase ! I thought that she would get her fees back automatically once the case closed.

So I don't know whether to agree to it or not. The seller put the item up for sale before the non paying case closed. Another person bid on it and won the auction, but I've noticed that its been relisted again.

If I agree to the cancelling of the purchase do I still get a NPB Strike ?

Dont close the case and pay for it. Thats the best option.

Usually a seller will only get one option of opening a dispute, But its not unknown for some to manage to get a 2nd chance.
    Probably rare though.

If you pay you get to leave feedback also. Keep it honest and truthful.

I wonder if it was the seller i commented on recently. Only allowed collection between 9 and 11am on a Saturday morning. No collections at any other time.

I thought im going to get a bargain but forgot who the seller was so missed it. Typical eh.

I think the case is closed, as it timed out so as the OP did not pay, the seller closed it.

This is now the seller attempting to get their fees back.

OP, do NOT accept the cancellation. Refuse it, them email the seller through ebay saying that you are still waiting for a date to pick up the item?

Why can't you pick it up in the morning? Surely that just means getting up very early?

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

I would not accept the canellation request, I think you have to actually refuse it, because if it times out ebay find in sellers favor ?

A single strike wont affect your account. But Id still contact ebay to try and get the strike removed as you did not refuse to pay as it was a collection only item.

If ebay remove the strike id try leaving feedback for the seller, I dont know if strike removal allows feedback to be left ? If you can then leave feedback do not mention the case/dispute or anything else that would allow seller to get it removed. feedback removal rules -
    http://pages.ebay.com/help/policies/feedback-removal.html

If seller leaves you any kind of negative comment as positive feedback, Id report it as feedback abuse under the rules above, ebay should remove it and seller gets mark on his/her account

Id also report the seller as a "non performing seller" for refusing to sell.

If an unoaid case has been closed against a buyer then seller has already received their fees back.

    Hi
Thank you all for your replies

Hi pink shoes, we couldn't pick up in the morning as my husband doesn't finish work until 10pm on the Friday evening and he needed the gap between driving as he drives for a living and I don't drive.

What the main problem is that I couldn't get the address off the woman, and when we got it, it was too late to go as didn't get it until the Saturday evening. We tried to make arrangements to collect another day but, she didn't respond to me and opened a case.

She relisted and sold the item to another person when the case was still open, she closed the case after it had been sold, which I thought that you could only relist and item on e the case is sold.

This may have affected her case as when she closed it she should get the final value fees off eBay, but this didn't happen. She had to request to cancel the transaction with me. I've agreed to do this and eBay have said that I'm no longer obligated to pay for the item.

I've phoned ebay and they've told me that I do not have a strike, which is good news.
