Desperate for Help Please

I really hope someone can help me. My husband got stopped by the police last night and the van was SORN (he had been using to get to/from work) as we are deeply in debt and have not been able to MOT it or TAX it, will he get a ban or just a huge fine or could there be a possibility he may have to go to jail.

I'm so desparate so any advice is appreciated.

    If there was no tax, and the vehicle was SORN, then the answer is clear - NO. Even if he did somehow have insurance, the above would invalidate it as the insurance company would have T&Cs saying that cover depended on the vehicle being road-legal.

    Huge fine - yep

    Ban - possibly, especially if he already has points.

    Driving without insurance is incredibly irresponsible (and, as stated, if he had no MOT then he had no insurance even if he paid a premium). Frankly no-one would give a stuff what happened to an uninsured driver in an accident, but risking uninsured damage to third-parties is unforgivable.

    Your husband will deserve whatever fine he gets.

    He was irresponsible but I think the important thing for you all is that you don't compound your issues by panicking and making another set of rash and bad decisions. Don't beat each other up about the situation- it will take up valuable energy that would be better used elsewhere. Use this as a wake up call to review and get help with your debt issues so that your are prioritising your expenses properly. Accept the fact that he will be punished and work as a team to deal with your whole situation.

    No, neither invalidates the insurance.

    I agree with Mr B, driving without insurance deserves prison, however, his is more than likely to get a spender.
    You never know how far you can go until you go too far.

    if you cant do the time , dont do the crime

    plenty of people go to work by other means and he should have done the same

    you cannot expect sympathy when you dug this hole for yourselves

    sorry to be blunt but people never seem to take responsibility for their actions any more , so I suggest you do so in future and dont drive a vehicle illegally because you may hit my grand daughter by being irresponsible and then you have involved others in your foolhardiness (which you are doing now by posting about this)

    if suarez was guilty , he should take the "hit" , its no different !!

    We are FULLY aware that we were in the wrong but there was no other way he could get to work so I apologise.

    He has no previous and no points and yes we are aware that the fine will be huge we can't actually feel any worse at the moment than we do.

    I believe the insurance would be null and void as the vehicle was not legally on the road

    Driving without MOT invalidates your insurance, and can also give you points on your licence. It's only not a problem if you're actually driving your car to get the MOT done.

    If you have current insurance, and preferably a printed copy of the policy, yes, you will be insured. No tax, or MOT makes no difference to the insurance. edit - print out a copy of your documents if you haven't already got one, you may well be asked to produce them at some stage.
