You say you can remember in detail a conversation you had 20 years ago, I doubt that very much, even if you can, it is irrelevant, you have nothing on paper to back this up.

Any debt you did have would be statute barred now anyway, so it wouldn't appear on your credit file.
Also, because you voluntarily left your job [unless the constructive dismissal ever judged as that by a tribunal for example?] it wouldn't have paid out.[/QU

So how come I have read on this forum people not having documents and still receiving payouts that are nearly 20 yr old?? Why would the ombusman take on a case if they thought I was wasting their time ( as this has been put to me ) finding this all very confusing! I have just read about a person who received the exact same correspondence from the bank and they took it to the ombusman and received their pay out.0 -
Any debt you had that was defaulted and not acknowledged in wirting or by payments for more than 6 years becomes statute barred.
It will fall off your credit file.
If you could find documents though, and you did complain and were successful, they can still use any redress towrds the debt first, no matter if it is statute barred.
They won't come after you for the money, but equally, you cannot receive money from them until the debt is paid in some way.Non me fac calcitrare tuum culi0 -

Yes I can remember every conversation because I only ever had 2 loans in my life 1994 was first and 1996 was the last. I had never had any debt before and never had any after. You have no clue to the duress I endured in that period so please do not be to harsh with you judgement.0 -

Just just to confirm lloyds did reject my claim and I took it to the ombudsman. I also sent away for my SAR and it showed that I did have a PPI with my 2 loans as well as a 3rd loan that I forgot about.0

I would just like to say to both of you that basically gave negative advice that I was missold my ppi along with my loans. You said that I would be £10 worse off! Well it was worth it, as it provide evidence that I had an extra loan which also had a PPI. With regards to me not remember every detail my records proved right again. I was able to tell exactly the reason to why this loan was taken out and it was confirmed by the information I received from the SAR. Not all of us have had debt all our life's that it becomes a non existent memory. Some won't ever forget. With response to the other comment about my debts that would be statue barred and that I wouldn't receive money, that is also bad advice. When the ombudsman looks at each case they also take into consideration as to what put me in the predicament that I was unable to continue with payments to a loan which had a PPI in place. PPI were sold to people and they were NO warnings as to what categories they DID NOT pay out. So that is all part of the misselling. In future this forum is to help and not to be used for people who have nothing but negativity to say unless it is constructive and may be of help to a person then I suggest you take your lack of knowledge in this area and seek another in which you may be helpful... I cannot say it's been a pleasure but goodbye0

You may have been sold PPI but unless you were dismissed, rather than resigning then it would not normally pay out.
That is not to say that the policy was missold.
However, as the bank is a creditor of yours and has no realistic prospect of getting its money back, it can argue that it is reasonable for it to use the right of setting off - particularly as you say you have no other debts.
So it would be unwise to assume you will get anything back at this stage.0
