Bought top - now ripped!

Hello all,
I bought a lovely top from New Look on Sunday, I wore it at work the next day but unfortunately I noticed a rip in the elbow halfway through the day.
I'm not 100% sure about my rights here because I can't say for certain whether I ripped the top or I accidentally bought it like that (I did try it on in the shop and didn't notice a rip). I was going to take it straight back to the shop, but figured that the shop wouldn't appreciate a worn top so I've washed it, now I'm not even sure if New Look will take it back.
Can someone clarify what I'm entitled to do or will I just have to accept the top seeing as I've removed the labels, worn it and subsequently washed it (I still have the receipt).
I'm not too fussed if I can't return the top, I'm sure I can fix it :-)

The burden of proof is on the seller to show that this item was not inherently faulty so under sales of goods act you should have some maneuverability here. Just state that it was of poor quality and ripped because theoretically you did inspect the goods before purchase so i'm not sure how saying "it was there when I bought it" would wash... but you can ty!
They would possibly get it sent back to determine if the material was inferior but most stores can't be arsed doing that. You'll either get "fobbed off" or they will replace. Don't take no 4 and answer and threaten to contact trading standards, ask 4 the head office address and send them a letter. Usually it is ok though0 -

Retail staff hear this 'threat' all the time so it's unlikely to fluster them. And if you get a staff member who is aware TS don't deal with individual cases, you are even more likely to get fobbed off if you say this as they will think you don't know what you are talking about!
When you take it back, just be friendly and polite about it. I've found that retail staff in general are more likely to go the extra mile and help you out if you don't go in all guns blazing and get their defences up. After all, it will be a lot easier if you can get it sorted nicely in store, rather than having to go though all the effort of writing to head office etc.

Well I was going to suggest bypassing the store completely and go straight for a LBA to head office, then small claims, but thought better of it. :rotfl:0 -

My comment was under the assumption that the customer goes in, politely explains problem (in a way which makes sense under SOGA) and gets "fobbed off". Then you have to start making stuff happen if they are not going to help you when you are nice to them. The TS comment is an empty threat but meh you've got nothing to lose at that stage...0 -

This is MSE, consumer rights, not consumer wants, not consumer cons and not a place to be giving out made up advice with no legal backup. Nothing to lose? You have, you have lost all credibility.0 -

Hi, i worked at new look for a few years and they tend to be pretty good at taking items back, even after a couple of weeks of wear.
Take it in and i'm sure they will sort the problem out for you
