RBS PPI claim.

Options
Hi there,
Hoping someone can shed some light please?
After a very lengthy claim against RBS for PPI, I received my settlement figure, was then told that the payment had been dispatched in the form of 6 cheques and I would receive them by 23/6/2014. (Still no sign of any cheques) today they have decided that I'm not entitled to any of the claim, as it has now been offset against previous debt!! I don't understand how one minuet the cheques are in the post, and the next minuet I'm not entitled to any of the claim. Unfortunately I was previously bankrupt, but discharged from that in 2012. Has anybody else had this happen? And is there anything I can do about it please? I'm really relying on this money for my family :(

That means you are not entitled to any refund of premiums paid prior to your discharge date.
And is there anything I can do about it please?

No. It is part of the rules of bankruptcy. A Refund made (after bankrupcty) of premiums paid prior to bankruptcy are a pre-bankruptcy asset and you have no legal entitlement to them.

Most of the banks work on a multi-tiered basis where the person dealing with the complaint will not be the one that sorts payment. The one that sorts payment has to check if you had existing unpaid debts written off/arrears/defaults or were bankrupt. So, it could well show on the system that it has gone to the payment department but that doesnt mean you will get payment.

  • Thank you for your reply, it makes a bit more sense when someone else explains it.
It's just very disappointing when you are told it's been dispatched and in the post, and then it's not!
