Returning an item

I need to return an incorrect item to a supplier who has already lied to me twice.
They are suggesting I print out a pre-paid return label and post the item back.
I am wary of doing this as I believe that ebay require you to send the item backed by a tracked service.
Can someone confirm that if I were to use their suggested method, and they claimed not to have received the item, ebay would find in their favour in a dispute?

It has an address, a place to put the senders details, a place to put an RMA number and a square with:
r 1
ROYAL MAIL
RETURN POSTAGE PAID

Yes, I know that. That's the whole point of this thread.
The question I actually asked was:
If a supplier tells you to return an item using such a label and then says that they have not received it, will ebay side with the buyer, even though they are at fault for supplying the wrong item and they have told you how to return it?0 -
Use the freepost label but take it to the Post Office and ask for it to be sent signed for/special delivery and pay the difference.
If you just use the freepost label and they say they haven't received it ebay will side with them as you won't have proof of delivery.0 -
Who (according to ebay's rules, I know that according to law the seller is responsible) is responsible for the cost of the return when the seller supplies an item other than the one ordered? (I tried googling this but can't seem to find anything specific to incorrectly supplied goods by ebay sellers.)
I am feeling very militant about this seller because they have lied to me on at least two occasions.0 -

The law says the seller if they are a business seller, but ebay cannot enforce it. Although ebay state items must be sent back tracked I imagine offering the freepost would cover the seller under the law.
Using the freepost and paying the extra for tracking is the cheapest and safest way. It's not right that you have to pay anything for the return, but at least if you send it tracked you will be covered by Ebay/Paypal.0 -
I've given them the option of either refunding me the difference between the item I wanted and the one I got. (It is usable, just not the one I wanted or paid for but they lied about the dispatch and it's now three weeks since ordering and I don't want to wait any longer), or refunding the money before I send the item back.
I see no reason why I should trust someone who has repeatedly lied to me.
If thy will not accept either of these options I'll bypass ebay and take them to the small claims court.

If they do not accept them the better option would still be to use their freepost label and pay the difference.
Small claims court would be more time wasted, more hassle and you should follow ebay rules (return for a refund) before taking it further. For something like this, especially if it's a low amount, I'm not sure how far you'll get with small claims court. I don't know anything really about small claims court, but it seems a bit pointless going straight to that when you can return the item for a refund through the ebay system.
I think for signed for it'd cost you £1.10. Is it really worth taking it further for the sake of not wanting to pay that?
If you have proof of delivery then it doesn't matter whether you trust the seller as ebay will refund you if they don't. The seller has no choice in that matter.
You can then leave feedback and stars to reflect your experience. If they keep doing the same then they won't be selling long.0 -
