PCN at Hospital in Wales

Hi! Last week had Parking Charge Notice at Hospital. It states that I had parked outwith a parking bay. Unfortunately, I had responded to the company before I found guidance on here. I took photos of the site and the lack of white line markings for the bays (they had been almost obliterated/erased).
There are only 2 notices about the new arrangements for parking. I is the entrance to the hospital from main road, the other at entrance to car park. There are no other signs within the car park to state parking conditions, and main entrance to hospital building from car park is almost equidistant from the signs 50metres each side. I have sent notice of appeal electronically and have given my personal details. Is there anything more I need to do?

The parking charge must allege a breach of the terms & conditions of parking & not a contractual charge as NHS hospitals in Wales provide free parking for patients, staff and visitors. Any claim for damages for breach of contract must be a genuine pre-estinate of loss but as it is a free car park there can be no initial loss therefore the claim must fail.

Is it Vinci, and is it Morriston, Neath Port Talbot or Singleton Hospitals?
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Do as Redx said above and you will win at POPLA if you don't talk about white lines and mitigating circumstances and 'the story of what happened'! You can pm Stroma as he's in Wales & knows the car parks in some areas.

Stroma doesn't receive PMs (a lot of regulars don't as they can become inundated by posters requesting exclusive, personalised, non-public advice).

I'm sure Stroma will be along soon on here, especially as this is a Wales-based PCN.

    20th June 2014

    Without Prejudice
    Dear Sir/Madam Parking Appeal PCN

I write (e-mail) as per your appeal instructions against the issue of a PCN Breach Code 7 issued at xxxxxx Hospital on xxxx June 2014.
I believe the notice was incorrectly issued and applied, for the following reasons:
    1. There were no markings indicating the parking bay area.
    2. The distance between the parked car on my offside and my car was a reasonable space to allow me access and egress to my car.
    3. There were no line markings on my offside nor nearside.
I attach video taken by my in-car camera when I found the PCN, and later photographic evidence, both of which show (or in this case do not show) any line bay markings where parked.
Based on the evidence I have provided, I would ask that the PCN referred to above be cancelled as it was it was wrongly issued.

    Yours Sincerely,
    Name removed

Due to file sending limitations (exceeding 100mb) a disc will be sent by surface mail with fuller evidence.
