Loading bay fine from council

Options
Council CCTV operator issued me with a PCN for parking in a loading bay.

Their reason is that the vehicle is not registered as a goods vehicle. However I was using the loading bay to deliver mail to a shop on the high street. (returning ebay items back to the owner as they sold me fake goods). There was valid business reasons for me using the loading bay.

This is not listed as a valid reason for representation. Do I have a case?

    I have looked at the loading bay sign on google maps it only states..

    "Loading only [next line] max 30 minutes [next line] No return 2 hours"

    The PCN states "Parked in a parking place or area not designated for that class of vehicle [code: 23l] in a loading place for goods only"

    Would that alone be a valid reason for representations as the sign did not state "goods vehicles only"

    Yes, but don't rely on Google Streets, you have to be sure what the sign says now, it's possible it's been changed to Goods vehicles only.

    best bet is post on pepipoo with details , photos etc , they have experts about council tickets on there

    :( It's been changed.

    But there is no legal defition of a goods vehicle. Someone on pepipo appealed about their estate which they managed to convince the appeals that it was a goods vehicle.

    Yes there is.

    Road Traffic Act 1988 Part VII para 192
    “goods vehicle” means a motor vehicle constructed or adapted for use for the carriage of goods, or a trailer so constructed or adapted,
    An estate car can fall into this category, a standard saloon/hatch definitely can't

    One avenue would be to find out whether the Traffic Regulation Order has also been amended to reflect the change. Councils can be very lax about this as newTRO's costs them money .

    Why definately? A hatchback is just a shorter version of an estate.

    Because it is neither constructed nor adapted for the carriage of goods, whereas an estate car is designed to fulfil both a passenger and goods role, and in fact, quite a few companies use estate cars as goods carrying vehicles

    The council in question is London Borough of Barking and Dagenham. But I cannot find the listing of this council at http://tro.parking-adjudication.gov.uk/default.aspx

    Does it have their own system?
