    You no nothing useful about consumer law. Your advice is as useless as a chocolate fireguard and you are such a distraction to the main thread.

    Moneymaker, you are the only distraction in this thread, everyone else had finished with it but obviously you had to have your say irrespective of whether it was or was not relevant anymore ... people like you are exactly why threads like this go on and on and loose all meaning.

    Well, seeing as it was Moneymaker who actually started this thread, I fail to see how exactly they could be classed as a distraction, and as it was them that started it, how can what they write be irrelevant?

    This is a public forum, and provided what I write is within the MSE forum rules, I can post what I like with comments aimed at who I like, and I haven't stated that I don't wish to hear from you. (I find your posts entertaining in a strange sort of way).

    If I think someone is posting rubbish, I am perfectly entitled to voice my opinion about it, and your asking an opening poster to stop posting because you feel that their views are a "distraction in this thread" is IMO, a stupid comment.

    Yet again, brain not engaged ... I didn't ask anyone to stop posting, that was being asked of me, I simply stated that if people didn't want my views or opinions in this thread then all they need to do is stop addressing me, otherwise its simply a case that people want to antagonise for a reaction. You can't all have it all ways. As I've said many times, I preferred to get things back on track but its obvious people aren't for that anymore, they prefer to waste time and effort banging on and protracting this thread beyond recognition, crack on :)

    The Distance Selling Regulations have now become the Consumer Contract Regulations in the UK. These regulations now make it clear that if you have used the goods that you are returning - which would include removal of any factory seal - and are therefore not returning them in exactly the same condition as they were received, the seller can charge a restocking fee.

    If , on the other hand, you opened the package, realised it was wrong, so didn't open it further, just returning it within the (previously 7 days) 14 days since receipt, then the seller cannot charge a restocking fee.

    Having said that, what I am not sure about is whether or not the seller has to include that they charge a restocking fee, and the amount of that fee, in their T&Cs on Amazon.

    The new law is not retrospective, and did not come into force until June 13th. The OP purchased on June 7th so the Distance Selling Regulations apply. The seller cannot deduct anything from the refund.
  • Don't forget that the Consumer Contract Regulations came into force after the OP made their purchase so they wouldn't apply in this particular case.
    The OP's sale would still be governed by the DSR's, hence no restocking fee allowed even if the goods had been opened and used.
  • I have not found anything on here that I did not already know save for the poster who pointed out that Amazon sellers may not charge restocking fees in the initial returns. Despite this being their policy they allow sellers to do that.

    The seller has not responded to any of my messages.

    I am disinclined to shell out money for a phone call even via Skype. I will use them only for certain items in future and no gift cards.
