Invalid tax credit's payments - will i go to court?

    No need to go to CAB yet. What you should do is write to the Tax Credit Office and clearly mention that you want to do a SARS request for your telephone calls to the helpline. At this stage you don't need to go into detail as to why you want this.

    All calls to the helpline are recorded and there are strict deadlines which the TCO must adhere to in getting this info to you. You will be sent a disk of your calls. Listen to them and see if your recollection of the advice is correct. If it is, then you need to then ask for notional entitlement as it would be clearer that there was no deliberate intent.

    I'm not guaranteeing that you'll be successful but you will certainly stand more of a chance.

    Call them up by all means but a SARS request has to be in writing. If you do call ask them to check that your call in which you were misadvised has been recorded. I'm guessing you know the date. They won't be able to listen to a recording but all you need to know is that it is showing as being made.

    that's awful.

    all i can think of is finding an excellent lawyer who is highly experienced and will take on your case on the confidence that they will win and you will be able to pay them after the case is closed in your favour.

    do like.. a double case. divorce and sue him for damages to your life.


    I don't know what happened to my post, I just wanted to post that I have received a letter today saing they are taking no further action against me. Such a relief! I know I haven't done anything wrong but still the stress of maybe having to hire a lawyer when you are already struggling wasn't a great prospect!
