Vodafone Miselling Contract

Just had to take my complaint to the communications ombudsman but I wanted to see if I can be given a clear indication to my rights, so here goes nothing
Back in April 2013 I received a call from Vodafones Sales Upgrade team who informed my contract is due up very soon and they want to make sure I get the best deal so I went ahead with a Samsung Galaxy S4 package which came with inclusive 0845 and 0870 calls for an extra £4 a month making my package £37 a month. But they will give me my first three months free.
So place the order and I had to wait over 2 months to receive my phone (supplier issues so all was forgiven)
I found that my bills were exceedingly high despite the agent promising I will be financially better off and will save money (I never went over my usage or went abroad in this time)
So when I queried this in November saying I am not happy I would like to have the call listened back to as I feel I have been mis-sold they said "A manager will call you back etc" never did.
Some months later after multiple complaints in April 2014 I was told despite the promise I was never given the 0845 and 0870 plus I never received the free for 3 months on my account. So I let this all pan out as before never hearing anything. But 2 weeks ago I wrote a request for info to receive a true copy of my contract from the time and was told they have no record of it also they have no recorded call from the salesman who sold the contract to me and if I want to cancel I will have to pay £410.
Do I have a case to end my contract with no financial penalties here?

My guess would be it was a 3rd party seller saying they were Vodafone ...... I would be asking Voda to confirm the origin of the new contract.Back in April 2013 I received a call from Vodafones Sales Upgrade team ..............................................................

As Silk said vodafone should be able to tell you if they originated the contract or if it was a third party. Vodafone have a rep on here who may be able to help. Search some of the other vodafone problem threads to find the contact details.0

I take it its been more then 8 weeks now so Take them to ombudsman.
Also pass the msg to friends and family about it. so others dont fall into this scamWhat happens if you push this button?0 -
