Hi all, looking for some opinions on the best way to tackle this please! Our AST expires a few days after the buyers survey has been booked for, and we were initially asked if we would like to stay on a periodic basis before they found a buyer - we said we'd have to wait and see what else came up, now we've asked if another month would be feasible for us to get the perfect property (dates are a couple of weeks out so we'd be gone before the end of the month extension) and been told no via the letting agent as the solicitor says they can't exchange without vacant possession!
I'm no moron and totally get that, we have no interest in staying here and scuppering the sale (have entertained valuations, open house, buyer and his architect so far with no complaint), we just don't want to have to stick all our possessions in storage and have to sofa surf with family for the sake of a fortnight when they likely won't even have the survey result back by the time we vacate!
How can I persuade the LA to talk them into it for us? The same company is managing the sale yet they don't communicate at all, and the vendors are abroad so only communicate by email. I have found a way to communicate directly with the LL but not sure if she would be annoyed by a message from me, and also if the LA's nose would get put out of joint, but I'm desperate to avoid so much hassle when they're so early into the process

No buyer will exchange without vacant possession so unless you are going to force them to delay exchange until you have gone they wont agree to it.0

Thanks ruggedtoast, I understand that, but with the survey being done 5 days before the AST expires they won't be in a position to exchange for weeks yet anyway surely? We would literally not even want the full month!0

You don't have to move out until a court order evicts you.
That is your right as a tenant. If the LL can't get his ducks lined up in a sensible timeframe that's his problem.0 -

Yes we have the s21, not sure if it's done correctly, and I know we could just refuse to leave but we need a reference and would like to do this amicably! Having met the buyer I'd not want to sabotage him as he seems perfectly nice as well

Just explain your position, appologies for the inconvenience and keep him informed. IF the S21 is in order (big IF), it will be at least 6 weeks after expiry before he even gets a court date.

At the time of the renewal discussions being opened, at least 7 weeks ago? It was sent through at the same time as the letter asking what our intention was re renewal, then they said actually they'd sell0
