Since 2011 the £300 excess only applies if neither the driver nor the vehicle can be traced, in which case property damage will onli be paid for at all if the accident also involves serious injury.
However if the vehicle can be identified there's now no excess on untraced driver claims. At least, that's what the MIB say on their website.

Yep, it's the 5th EU directive0

The vehicle is identified so the MIB will deal with the property damage element of the claim as well as the PI under the Untraced Driver Agreement, but you won't get paid as quickly as you need or the repairs sorted / total loss payout as quickly through the MIB as you would when using your own insurer.
I would doubt a credit hire outfit would hire you a replacement car for the time it will take for the MIB to settle your vehicle claim when there is a fully comp policy to use.
So the odds are you are probably going to be best placed to use your own fully comp policy to get the vehicle aspect of your claim dealt with, unless you have a spare vehicle you can use and don't mind waiting months for your own vehicle claim to be dealt with?
I had a case recently where the driver of an Impreza stuffed it into my client's parked car outside his house late at night.
The occupants of the Impreza left on foot in a hurry. The owner of the Impreza claimed it had been stolen and reported it to the police as stolen. So his insurers were trying to dodge a bullet by relying on the fact it had been reported stolen and the driver could not be identified.
The airbags had deployed in the Impreza and samples got taken from the driver airbag by the police (as well as a load of claret in the passenger side from the injures passenger). Some months later, following DNA being taken from the owner, it revealed his DNA was all over the airbag :-)
So my client's claim got dealt with by the Impreza's insurer (Admiral) and the Impreza driver was looking at a stretch for attempting to pervert the course of justice.0 -
Thanks guys for all the replies. I really appreciate it.
I have decided to take it through my own insurance and wait and see what happens. Hopefully the police will be able to catch the thief.
Will I be able to claim my excess back seeing as i was completely innocent0 -
As has been said, the MIB rules have changed over the years and so it is probably worth speaking to someone with knowledge of the current system - your insurers will advise you and its in part what you pay them for.
In my day the excess could only be recovered if the thief/ driver was identified. If they werent then its your own loss to bare. If they are then you could attempt recover from the thief (generally a very slim chance) or the insurers of the vehicle in these circumstances become the RTA insurers and so can be made to pay but the process is long if they dont roll over and accept their responsibilities without court orders0
