Hi there I was hit at 25mph yesterday by a thief who had stolen a vehicle. It was completely his fault. I was too hurt to get out of the car but the thief fled the scene leaving the vehicle at the scene.
IS it better to go through MIB or my own insurance? Either way am I in a messed up position. My insurance company pretty much said im going to have claim against my own policy which didn't sound very interesting.
Please guys I have a very bad shoulder and can only type with one hand. Please advise me
Thanks

If you want it sorting any time soon go through your own insurance.
How bad is the damage to your car.....is it driveable?
If you do not go through your own insurance you may have a long wait to sort it all out.
You will lose 2 years off any NCB as it will go down as " at fault" but it might be worth it to save any inconvenience.0 -
So even if its not my fault then its down as my fault. How ridiculous is that.
Its not driveale. Damage only to one side.0 -
"Fault" when used over insurance claims doesn't refer to "blame", but to whether or not your insurer can get fully reimbursed from a third party.
Check whether your policy has any uninsured/hit and run extra benefit as some don't make you lose NCD after such claims where you are not to blame.
Note that your own insurer won't deal with your injury claim.0 -
Unfortunately, this is one of life's injustices. To get it fixed, somebody has to pay. So then you draw up a list of who:
- the car owner? He was minding his own business and didn't know it was stolen
- the thief? He's long gone for now and, if/when caught, will be potless and might even end up in jail for other offences
That leaves just you .... or your insurance.0 -
You will be able to claim through the MIB for the personal injury aspect through the untraced drivers scheme. You will not be able to claim for damage to the vehicle under the uninsured drivers scheme (as far as I am aware) as you don't know who caused the damage (and the excess is more than on most comprehensive policies as well).
So as has been said - get your own insurer to deal with the damage to the car and then get legal help (have you legal expenses insurances or a member of a Union/ trade organisation that offers this?) to pursue the claim for injury.
Most of the uninsured driver no claims bonus protection options are far less useful than many think as usually the at fault driver has to be convicted of driving without insurance - if they can't be traced then the benefit doesn't kick in.
Hope you get better quickly.0 -
If the thief can be found then you can claim from the company that insures the car - even though he was obviously not named on the policy, the road traffic act requires the insurer to pay any judgement made against the driver, regardless.
If the thief can't be found you're left with your own policy or the MIB untraced drivers scheme. As the vehicle involved was (presumably) identified you CAN claim for both property damage and personal injury from the MIB (link), but it can be a slow process and dealing with your own insurer would be quicker as far as fixing the car goes. However as you would have to claim from the MIB for the injury aspect anyway, adding the property damage to the claim might be something you'd want to consider as it would protect your excess and no claims bonus.0 -

... expect for the fact that it isn't true.
The MIB scheme was set up exactly for this sort of situation.
It is true that you pay for it (at least in part) in that every policyholder pays for it, because that's how MIB is funded, but that is a fairer way that asking the completely innocent injured party to foot the whole bill themselves. We need the earth for food, water, and shelter.

The scheme for property damage has gone through several changes in recent years but the current scheme is that all property damage claims will be paid in full as long as the vehicle is identified. We need the earth for food, water, and shelter.

I thought there was a £300 excess on untraced damage claims0
