It is more than OK! Many thanks. :)

It's the second time I have seen Christopher Monk say these words:

''The operator must produce evidence that such a notice has been produced regardless of whether the issue is raised by the appellant, as the liability is not based in the law of contract but is created by the statute.''

here he said the same, and unlike you, the appellant had not even mentioned the NTK flaws:

You may also like to add it to the 'POPLA decisions' permanent 'sticky' info thread at the top of the forum, for posterity.

My notice to owner was outside the 28 to 56 days allowed which helped, but it appears it wasn't compliant in other ways too.
  • Hi sorry for hijacking but just lodging an appeal with popla and was reading this thread and reference was made to having the full 28 days to appeal I have not had the full 28 days as letter from ppc was dated 24/9 but post mark says 2/10 it actually dropped through letterbox on 7/10 leaving only 15 days to appeal is this right checked and its a valid code ?

    Check it here:

If you're in time, don't make any big issue of the date - get your appeal off soonest.

If you need more advice, start your own new thread on your PCN, but work through the NEWBIES FAQ sticky, post #3, 'How to win at POPLA' first, before seeking more input from regulars.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
