Hi there
Looking for help from someone cleverer than me to help me understand the details on my husbands credit report.
2 debts - one Barclaycard one citicard, both for similar substantial amounts - neither can produce a valid CCA.
Barclaycard debt being dealt with my Lovells (although it never actually passed to them on credit report) they realise the implications of no CCA as soon as they were challenged & marked the debt as satisfied so it now appears under 'closed accounts'
Citicard debt being dealt with by Cabot (and showing as Cabot on credit report) they decide to go to court, but when asked to produce CCA by Judge they 'withdraw their claim in its entirety') - this shows as a default on the report with another 20 months until the 6 years is up.
There was no difference in the 2 cases & cant understand why Barclaycard would mark as satisfied without being asked, made me wonder whether I have any rights to ask Cabot to do the same?
Many thanks

Usually in response to a failed CCA request the creditor/debt collector won't mark the default as satisfied, so I think barclaycard are the anomaly rather than cabot.
That said and considering that they did go as far as court action I would think it is worth a try for husband writing to ask them to either remove the entry entirely or mark the default as satisfied if he may be trying to obtain credit before the 20months are up.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0
