Excel Parking - Chorlton !!! Hardy - Help/Advice Needed Pls

Hi,


I took a call while driving (Bluetooth through the car), I pulled into a side street and parked up to take the call safely. It was raining and going dark so I didn't realise/notice any signs.


I have received an invoice from excel parking on the 19th May 14, saying they are charging me £60 if I pay within 14 days and £100 afterwards.


I appealed there invoice via email:

"I am appealing/challenging this invoice/fine because I received a phone call whilst driving before entering the car park, I used the car park to take the call safely. After finishing my phone call I left the car park immediately. Whilst on the car park I never left the vehicle.

Attached to the email is my latest phone bill, showing on the 10 May 2014 the time and duration of the phone call.

I feel dissatisfied about receiving this invoice/fine for just taking a phone call safely."


My appeal has been rejected, I have until the 19th June 14 to pay the £60 or it will be £100.


I need some help/advise on whether to pay the invoice or what to do next, I've read that people are just ignoring there letters.

    You need to read the newbies thread, then ask questions if you don't understand what you need to do.

    I used the info there recently and 'saw off' CP Plus.

  • I've had a quick read through it earlier, I'm just unsure if I've got a case with me taking the phone call and not paying for a ticket.

    I'm unsure whether to appeal to POPLA.

    I've read new & old posts on here, but I haven't found any similar to my situation. That's why I'm unsure and seeking help/advice.

    doesnt really matter about finding similar situations as yours , the facts remain the same no matter what the circumstances, because popla dont allow mitigation and the parking companies rarely allow it either as they just want their money

    eventually you will realise you treat it as an invoice and appeal it based on lawful appeal points, not mitigation and not "what happened" either

    or if you havent got the time then pay parkingticketappeals to do it for you

    Just out of interest, where in Chorlton-c u m-Hardy did this happen?

    Just want to know so I can avoid the area and the hassle!!

    EDIT: The filter thinks the name of this lovely little place in Manchester is rude, so edited it to put a space between each letter!
  • The Car Park is off Wilbraham Road A6010, at the back of Graeme House. Don't know the street name, the street is a cut through with the car park (small) on either side, I'm guessing they will invoice you even if you drive through?!


    I was on the phone for only 20 minutes and got £60 invoice, think its only £1 for a hour (what I've been told).


    Definitely Avoid!!

    That always makes me smile - I have 4 kids and a husband and a full time job in a school and I wrote the thing! If you want something done, ask a busy person... :)

    Anyway I think you missed one of the first things I say in the sticky thread and that is that 'what happened' DOES NOT MATTER and you always have a case.

  • That's so unlucky because ive run into quality save on 2 occasions without getting a ticket. I will never do it again after reading this! x
