Thanks I will check the covenant, will it be in the deeds of my house? My house was built 30 years before his.
The council seam pretty helpful, they have written a letter to him with a leeflet about the hedge row act that he is potentially in breach of.
That is an interesting case where that guy was charged. Surely that should work in reverse to be fair. So I could sue him as his tree is reducing the value of my home as my house was built first and when I bought it the tree was not visable from my land?
This whole idea that its my land I can do with it what I like isn't quite true. You only own the topsoil so no mineral rights and anything other than a small shed or tree house often needs permission.
Well I can't really offer him anything other than apeal to be unselfish. I struggle to stay in the black at the end of the moth and he has high end cars...0 -

Except he's not committed a crime by planting the tree...
Sadly, it's a risk you take when buying a house. Neighbours might plant trees, might turn the garden into a kennels, might let the place go into disrepair...can do any number of things they like to reduce the value of your property and there's not much you can do about it.0 -
If the trees are only 4'/5' from the boundary there's a good chance the roots are growing onto your side. If it were me next time i was doing the garden i'd find them and start watering them with a strong weedkiller, and each time i did the garden i'd water them a bit more. Maybe just maybe they'd start to die.
Don't admit to knowing anything about it.Liverpool is one of the wonders of Britain,
What it may grow to in time, I know not what.

I'd think they wouldn't be able to turn it into a kennels without applying for a change of use?
Lol really not going to use weedkiller, I have a herbicide free garden with all my fruit and veg in.
He looks in his 70s, will just have to hope he pops off soon though the enjoyment hes getting from annoying me is probably adding to his life.
If I during a windy night attached some ropes to the tree, then my car and then pulled it down then it wouldnt be too suspecious.0 -
Might just buy some extra long pruning sheers, every couple of weeks loop a branch off.
Or import some pest to gooble it up.0 -

Depends on what kinda thing they were doing, really...but there was a thread on here not long ago where the OP had the neighbour build a massive "outhouse" for their dogs at the bottom of the garden and the dogs were barking 24/7 etc.0 -
Moral. If you buy a house for a view, make sure you have control over the land you are viewing.
How would you like it if your neibough asked you to cut down trees in your garden?
Also, a tree is not a hedge. I'm think there needs to be at least three planted close together to count as a hedge. I doubt very much that the council will know what they are talking about.
Maybe if you were more considerate towards your elderly neighbour and asked if there was anything you could do to help him etc, he might be kinder towards you.
Wishing him dead is not the answer - he could be replaced by a true neighbour from hell, then you really will have a problem! imagine parties every night etc. That's an experience I've had, whereas I've never had any issues with elderly neighbours.0 -

I'd probably think "OMG, the tree I've planted is making someone else's life worse" and cut it back, like most reasonable people.
(let's not exagerate here, OP hasn't asked for the tree to be cut down altogether)
If they actually offered to pay for it to be done, I'd be thrilled - although, I probably wouldn't accept. Keeping the stuff I plant in check is kinda my responsibility...0 -
