    That is exactly correct, I'm sorry if I lost a few of you along the way, as I've said this is all new to me, but has been interesting and farcical if you new all the details.

    I also apologise if me ignorance spawned the few hard replies I got, I personally don't thing that was called for but this is the internet, some get off on it.

    As I said I do believe in seeing posts through, so hopefully this is an end to it.

    I still don't understand. To whom did they pay the money? To the fraudster for his claim? Or to you because the fraudster didn't defend your counterclaim and hasn't paid you for that?


    My insurers gave me the option, they would either accept the claim and pay HIM in full, or pay ME and let me take my chances in court without their assistance.
    You can probably tell be my earlier posts, and yes, I was incensed at this, I could not capitulate. The money is in my hands and yes, the insurance lost out.
    Luckily, and this was a consideration, Legal Protection claims do not count as claims in terms of home insurance with my policy.

    The bottom line and the reason hew did not contest my counterclaim was that after pressing Ebay very hard, I found that in actual fact they had not reclaimed the refund they paid to me from the seller, therefore he had suffered no loss.

    Did he win, morally or financially?
    Well he got his goods back and my £30. He paid £25 for his court claim.

    I got my money back and the insurance claim.
    Doesn't really seem totally fair, but I suppose I will have to leave it at that.
