CAA have agreed my claim...

Hi
I went to Cuba last sept and on route to Manchester airport we got a text to say our flight would be delayed as it had been delayed in Mexico. When the plane eventually landed in Manchester we were given a departure time which was also delayed, making our delay time around 7 hours. When we arrived back home I contacted Thomson and was given the standard response aircraft safety and quoting EU regs etc, so I contacted the CAA. They responded with 10 days and said they had sent my claim off the Thomson. Yet again I received the standard Thomson response , so I again contacted the CAA, who again responded with 2 weeks and said that Thomson were liable as the response they had from them didn't fall under "exceptional circumstances" and that they had told Thomson of their decision . I again contacted Thomson and sent the CAA report to them and yet again I have a response from Thomson who are saying the flight was delayed due to "spoiler" issues which they believe are "exceptional circumstances" and they are still refusing to pay....where do I go from here? Back to the CAA or look at going to court, what are my chances? :j

Should be on Thomson thread but read thread first as answers on there. CAA a waste of time but their letter may (slightly) assist when you take Thomson to court - go either DIY or if you think you may find that difficult go NWNF.0
