ParkingEye Payment Notice

I have been sent a "PARKING CHARGE NOTICE" from the clowns @ ParkingEye for the amount of £40 if paid within the next 14 days (14/06/2014), if not paid within 14 days the amount will increase to £70:00.
I parked in an Aldi car park and returned 2 hours and 14 minutes later, and the maximum free authorised stay was 2 hours.
I have done a bit of research on the internet and there are views that to merely ignore any correspondence from ParkingEye, and others such as the AA...., they say that it is best to appeal against the decision as Court proceedings by Private Parking Companies are now more frequent, especially ParkingEye.
I don't really know where i stand on this matter so would really appreciate some help?

Yes, if this was in England/Wales you need to appeal. The law changed in 2012 meaning that anyone still giving 'ignore' advice is horribly out of date. ParkingEye are extremely litigious.
The first step is to appeal to ParkingEye using the template in the first post on the Newbies sticky thread. When ParkingEye reject your appeal your next step will be to appeal to POPLA.0 -

Yeah, the first template appeal to the PPC applies, but the POPLAR appeal template in parts do not apply to me, which I need help on what to write in it when the occasion arises.

That's not a problem, when you have your rejection from ParkingEye just post on this thread again (don't start a new one).
You can then post up the POPLA appeal you intend to use and we can advise on what you can remove/add etc.0 -
As you are in England or Wales send the template 1st appeal in as da_rule has advised.
Do NOT ignore - P E take considerable numbers of people to court and are the most litigious parking company.
Then spend time reading up on How to Win at POPLA.
As you become more familiar with the issues you will probably see that most of the points in the P E POPLA examples will apply to you too0 -

On would you believe, April 1st my wife inadvertently overstayed her welcome by 48 minutes at a retail park managed by Parking Eye. We received the PCN and I started researching...
On April 11th using the template I replied to Parking Eye
On April 24th Parking Eye rejected my appeal and I received POPLA code.
I submitted my POPLA Appeal again using the templates
On June 6th we received the following from POPLA:
The Appellant appealed against liability for the parking charge.
The Assessor has considered the evidence of both parties and has
determined that the appeal be allowed.
The Assessor’s reasons are as set out.
The Operator should now cancel the parking charge notice forthwith.
Reasons for the Assessor’s Determination
It is the Appellant’s case that the parking charge notice was issued incorrectly.
The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were.
Accordingly I have no option but to allow the appeal.
