    Alas, Mum isn't so great at the moment (nothing serious, just old) so it's me who is looking after her!!! I say looking after her, it's more a case of I microwave 2 meals instead of one and make her endless cups of tea... I think in the grand scheme of things, her having me home is a good thing because she struggles with a lot of things now (although she loathes to admit it) but I feel better being around to help her out as much as I can too :)

    Oh well, at least you know she's safe and looked after and I'm sure she appreciates having you there. Time for al those questions about family you'll want to know one day and never had thought to ask before !

    P.s. BF having a terrible birthday so I took over some Haribo (other gummy sweets are available:rotfl:) and we had a good laugh, seems they are the sweet of choice !

    Morning all, does anyone else have one of those body clocks that just goes *BING* and you're awake?

    Sazz, I probably already know more than I want to about my family LOL ;) Mum keeps asking if I remember when my uncle did this or my gran said that, etc. which is fine except my uncle invariably said it to me in the 70's when I was a toddler and my gran died when I was 7!!!

    It is nice being around Mum more really though, she has some slightly "outdated" opinions on somethings so we do have our disagreements and she can't help herself hating Cheryl Cole (or Ferdinand-Gomez-El Diablo or whatever she is called) whereas I personally *cough* don't mind her so much...

    Although not sure how many of you will remember me.....
    LBM.....sometime in 2013 £27,056. 10 creditors
    June 20.....£7,587.....3 creditors left 72% paid

    £26,200 on interest only part of mortgage (July 16)...will chip away £17,103
    £49,200 repayment mortgage ( July 16) £37,764

    Cheryl Cole? Beautiful girl :) !!

    Such a pity about that tattoo though. When you're beautiful why ruin it? She made an awful mistake there and I think she will live to regret that one in a big way :(

    I know right? It's like she has tried to camouflage it or something... I guess roses are better than green and black splotches or Zebra stripes LOL

    I'm in need of some advice from some seasoned money savers please! Like almost everyone on here I have made mistakes in my life and I am currently trying to rectify them. Our brief debt free journey so far is as follows:

    My wife and I are almost 2 years into our DMP with PP. We started off at around £48K and are now at around £33k. We had a bit of luck with a Barclay's loan and they wrote of nearly £5k due to a mistake they made with our interest.

    We are currently paying £1k pm towards our debt, we started off at £750 pm but have both worked hard (to near breaking point) to get promoted in order to earn more and pay off our debts sooner. Due to my occupation, I need to be very careful how manage my debt so I can't do anything to drastic.

    We have 12 creditors and thanks to PP we only pay interest to Barclaycard. My wife owes them £6k and I £4K. Payplan have asked Barclaycard to freeze our interest and they have declined, from browsing the forum it appears that this is a common occurrence with BC.

    Having taken advice on this form I wrote to them myself, they declined again. I then requested a copy of our original credit agreements and a full breakdown of all interest and charges (I used a template letter from this forum).

    Barclaycard subsequently responded to my request under Section 78 of the CCA 1974 and they enclosed what they call a "reconstituted" copy of credit agreement. The agreement is pretty generic, it is NOT signed or dated by me. My wife received a similar letter.

    With regards to my request for a breakdown of interest and charges they advise that this has been passed to a separate department. No response received as of yet.

    Have Barclaycard completed their obligation? For example should the credit agreement that they sent me have been signed. The one they supplied could realistically have been plucked out of thin air. Can they prove that was the credit agreement that I received when I opened my account (circa 2005) and do they have to? I certainly don't recall!

    For the record I am not looking to walk away from my debt with Barclaycard, I am prepared to pay what I owe. I am just trying to find some wiggle room with Barclaycard to negotiate the freezing of interest and the repayment of interest paid since commencing my DMP. I totally understand that BC are not legally obliged to freeze/return interest, but I have to try!

    In addition I note that they haven't defaulted us on our accounts, although they threated in the response to my request for our original CA's. I had a look at our accounts on Noddle and they showing as up to date, despite us having had a DMP with Payplan for almost 2 years and making reduced payments.

    Someone suggested that I should complain to the financial ombudsman? Should I send a second letter to BC first and complain to them direct before going to the ombudsman? Does the reply from BC in respect to my request for the original credit agreements give us any room to manoeuvre/negotiate with them? Or should I just give up? We owe about 90% of our debt to Barclays/Barclaycard, although I/we except responsibility for this I honestly don't believe that they acted as responsible lenders and were partly to blame for our demise; giving us credit we couldn't afford until it got to breaking point!

    Your advice/guidance would very much appreciated. Thank you.

    Another glorious day, the sun is shining (probably, I'm assuming it is as it's lighter outside now than it was at 06:00 today) and it's the start of a new week :) I hope everyone has a great start in the run up to Halloween!!! Oooohhh....

    CU, welcome to the thread :D you've made some cracking progress on your DMP for which you should be applauded, that's a third of your overall debt smashed in just 24 months! Kicking a$$ and taking names ;)

    You're right, Barclaycard has a bit of a "reputation" in these parts although I'm not sure why as personally I love 'em :D they've always been helpful and friendly to the point where I almost feel they are a member of my family *cough*bull$hit*cough*...

    I've no experience of sending out the CCA 'prove it' letters but I'm certain someone more knowledgeable will be along shortly but I believe that if they are unable to provide a signed agreement then the debt is unenforceable (there is actually a forum thread dedicated to this very subject too if I recall correctly)? Have you spoken to PP since getting the unsigned document? What was their advice?

    As for getting the interest stopped, I believe you're halfway there in getting the accounts defaulted as this means they've acknowledged that you're not going to be on a short term managed payment plan... How long has it been since you defaulted? From experience (and conversations with BC) they charge interest on the %age of balance paid, so if you pay more than 1% then they lower interest but if it's more than (I think) 4% then they apply full interest regardless :(

    What are you currently paying to them via your DMP? What %age does this equate to? Paying more each month can actually be detrimental as they then get more money making it more likely that they will charge you! (Think EU £1.7bn "refund" being demanded from the UK for being good).

    I don't know about the CCA request, hopefully someone on the main DFW forum will answer your question there.

    Regarding the complaint to Barclays, the FOS will not take up the case until Barclays have provided their final response but if you have already complained and Barclays have taken more than 8 weeks to respond, you can ask the FOS to intervene now:
