Filing date for hearing

Hi, i have sent my full defence off two weeks ago and was about to send my witness statement off this morning. However i have just seen on the Pranksters site the arguments to use if PE use HHJ Moloneys judgment against me in court. Can i add that to my witness statement and then send it along with the evidence, photos etc. PS, my filing date is June 9th, Thanks for any help/advice offered.

Strictly speaking no, but as PE do so with gay abandon (other types of abandon available) then I would go ahead. The filing date is prior to allocation and so there will be some time before the matter comes to court.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

My hearing is in just over two weeks. It was an amended defence that i sent in a couple of weeks ago, my initial defence went in a long time ago. hence the need to get this dealt with. iI will need to take the remaining paperwork into court tomorrow and post off to PE.

    Well done!

Could you possibly tell us which court this was who agreed it, and how did you achieve it exactly? In your witness statement did you ask outright for the claim to be adjourned & the hearing vacated?

It was Bolton County Court. I am waiting for a letter of confirmation which will have the name of the Judge on it, should be here tomorrow. It has been confirmed over the telephone but i cannot remember the name of the Judge. I will post it as soon as i get the letter, could be Sunday though as i am away tomorrow until Sunday. I found the info yesterday on the Pranksters blog, so i drafted a letter and took it straight down to the court building. I was told that the Judge would take a look, and for me to ring later in the day which i did. Happy Days.

On Monday there are two 10am ParkingEye cases scheduled at Bolton and one at 12 noon. Any chance you can email or fax or pop in first thing, to ask the Court to use your letter for the other two cases as you are an 'Amicus Curiae' but do not know either of the other two PE defendants ?!

The 3 case numbers for Monday which will probably still include yours as our news info won't have been updated, are:

    A0JD0447
    A0JD0094
    and A0JD2959

Hi Coupon Mad, Yes i will go down to Bolton in the morning. My case is not among those so i will take 3 copies of my letter and copies of the appeal letter. Do i leave my letter as it is? IE leave my address and phone numbers on or omit those details? PS, when anyone is trying to get their case adjourned and they do it by letter, they must put on the envelope and more importantly the letter URGENT HEARING DATE and the date of their hearing. If they do not put this on the letter then the letter may not even be opened for 8 days or so.

That's great, very good of you - as two cases are listed for 10am you'd need to get there at opening time (9am ish!).

    PUT:

FOR THE ATTENTION OF THE DESIGNATED JUDGE TODAY IN THE PARKING EYE CASES AT 10AM (TWO CASES) AND 12 NOON (ONE CASE).

URGENT AMICUS CURIAE INFORMATION PERTINENT TO THE THREE PARKING EYE CASES BEING HEARD TODAY (AND ALL PARKING EYE CASES PENDING).

Then list the 3 case numbers I gave you above and the date.

I believe you should identify yourself with name, address and phone number, yes. And state you are not known to the defendants but have just had your own case adjourned and you noticed there are 3 more cases listed today which should be entitled to the same adjournment or at the very least for the information about the Parking Eye v Beavis case going to the Court of Appeal, being advised to the Judge in each case and for future pending cases with the same Claimant. Say it would seem unjust not to afford the same information to other defendants who may not have been aware that one of the cases PE are relying upon is not as 'persuasive' as it has been painted by the Claimant - and in view of the situation it would seem fair for all this Claimant's cases to be identified and adjourned, you suggest, unless the Defendants wish otherwise.
