Interesting thread this about the terms of the extended warranty changing.
I've got a Porsche and their extended warranty terms regarding where the car must be serviced also changes each year.
2 years ago it could be serviced at a reputable garage in accordance with the service schedule and using genuine Porsche parts. Last year it changed to having to use Porsche for ALL maintenance work, including changing brake pads.
Due to renew again this October; no doubt the terms will have changed again0 -

The terms may change each year but the T&Cs that are applicable are the ones in force (and you received in a durable form) at the time you took the warranty out.
I know, which is why I read them very carefully before renewing the warranty each time. And, if necessary get Porsche GB to confirm any points that aren't clear.
I just thought it interesting BMW do the same with regard to their extended warranties. I wonder if all manufacturers do it.0 -

I can imagine this stinging people who renew their warranty without checking/assuming it is the same!
I have read that during your warranty with bmw the servicing is to be done by themselves.
BMW have rang me to tell me they're sourcing the problem (they're now on day 4) and then it is down to the bmw warranty company to decide what happens. Either way the diagnosing is it a fixed cost so it won't hit me too hard.
If warranty fails to pay then I will put an email together explaining how I feel the warranty was mis-sold and hopefully see some money back from it. I won't hold my breath.0 -
I'm still confused on how you think the warranty was mis-sold. If anything the only mis-selling was done by the garage who sold you car that had been tuned/remapped and then only if they misrepresented the sale.0

Because the guy at BMW is telling me it needs to be full bmw service history..
I have emailed the garage I bought it off explaining how I am still within the 6 months of purchasing meaning we can assume the car was sold with the problem and it is down to the garage to prove it wasn't. I also bought the car under the impression it was standard, this is not the case and I expect them to pay for any repairs carried out by bmw.0 -

But that's not the main reason why they wont honour the warranty, it's due to the mods on the car.
Which is why I have contacted the garage I bought it off but BMW would still refuse to pay for the likes of a wheel bearing which has nothing to do with a remap. Therefore they have surely mis-sold the warranty. A remap would only void the likes of turbo's, fuel pump etc. Where bmw are using the fact the car doesn't have full bmw service history as a get out when in the terms and conditions it isn't asked for.0 -
I've sympathy with you OP as you answered honestly, with the information you had, the questions put to you by BMW. One could argue they should have corroborated your answers with an inspection. Although if they did that they wouldn't have needed to ask you in the first place.
Porsche avoid this situation by insisting on a full inspection, costs about £200, prior to issuing an extended warranty on a car, even if you're just renewing one.
Part of this check involves examining the on-board computer data to look for software re-mapping. They also look at the maximum revs the engine has done. If it has been revved too high you have to pay for an additional check to make sure the engine won't go bang. If you won't pay they refuse to sell you the warranty.0 -

Even the dealer selling is very unlikely to know that a car has been remapped. Unless they go to the level of downloading the whole map, find a standard one and comparing it to see any differences they wouldn't know. And I can't see a dealer doing that for every car they sell.Remember the saying: if it looks too good to be true it almost certainly is.0
