iPhone 4S wont turn on. Are Apple likely to be able to help?

* My brother bought an iPhone 4S from CEX some time last year. It was in their top rating category (A+, A1 or whatever it's called). I saw it myself when he brought it home & it looked brand spanking. I know this is no indication of how new or good it actually is.
* All was fine until recently, it was struggling to hold charge & now it wont turn on at all.
* Have plugged it in - it wont charge. I've tried it myself. The thing i noticed is the power on button is totally stiff. There's no 'down', it just wont budge. I've tried pressing it against something hard (like a solid wall) & i suppose this presses it down but it just wont turn on.
* The phone isn't & hasn't (in his ownership at least) been jailbroken. No idea if it was beforehand.
I remember ages ago someone saying that if you go to Apple store & they can't fix it, they'll GIVE you a new one. I can't see that happening myself. Perhaps a new one at a discounted price but not GIVEN.
Anyway, are Apple likely to help in this situation? What would they do basically?

As it's obviously out of warranty with Apple, then they will replace it with a refurbished phone. It will not be free - there will be a charge which you will be told about.
Apple have been known to do a replacement free of charge when it's just outside of warranty.0 -
You can check the warranty status by plugging the serial number into https://selfsolve.apple.com/agreementWarrantyDynamic.do
You can find the serial number on the box or on the sim tray. You can also find it in settings/general/about although that won't help if it won't power on.
If it is out of warranty (and it probably will be) as the other poster says Apple will replace it however there will be a charge for this. The replacement unit will have 3 months warranty so should it fail after that your brother may find himself back at square one which is something to consider0 -
Out of interest what do they 'usually' replace with? Or is there no 'usual'?
His is a 16GB iPhone 4S. Since they don't make them any more, what's he likely to be offered (5C is my guess?) & what sort of discount on it?

It would be replaced with the same model. Apple stores generally have stock of refurbished units of most models which they use for replacements. If they don't have stock, they can order one in or you can use the mail in service instead0

LOL, some wishful thinking there. Apple still have stocks of the iPhone 3GS available.
You will get exactly the same model/capacity/colour, even if you are paying the out of warranty fee.====0
