Whether you "sneaked parked" or not, whether the monitoring system is up to snuff or not, is of no consequence whatsoever. The only thing that matters is, did you cause the PPC or the landowner to lose the amount they are claiming?
If not, it is a penalty, and penalties in consumer contracts are not allowed. You can throw in other things, signage, planning permission, contracts, UTCCC, but, unless their claim is for a genuine loss they may as well urinate windwardly.You never know how far you can go until you go too far.0 -

Following these replies I feel re-invigorated to keep pushing ahead with this. I'll send one last email to sainsburys and then proceed with the POPLA appeal.

The Deep - its comforting to know they basically have no leg to stand on over this.
Half_way - I've reiterated this to them many times but Sainsburys don't seem to really care.. They insist nothing is wrong with the entire process of how their agents track cars, issue tickets, proof, etc
As a side note, I did write to sainsburys informing them that I would post online the entire thread of emails (they are truly ridiculous) between them and I should the situation not be resolved so as to warn other customers. Specifically on their facebook and twitter. Would anyone suggest I go ahead with this or just leave it as is?0 -

Hi Everyone,
Just wanted to update you all on the situation. Firstly thank you to everything for being such a great help. I didn't let up on Sainsburys, and in the end they cancelled both parking tickets, and indirectly admitted a flaw with their monitoring system by saying that they are looking to use technology to supplement it. They also said they won't correspond on the matter any more. Typical. But end result is great. Thank you all!0 -

Great news Unit; the power of the complaint to the principal.
I think they need to take a long look in the mirror and ask themselves exactly how much of a problem there is from rogue parkers (non-customers, who might be systematically abusing their car park).
Ask them to weigh that against the intention to invest in more technology (probably a serious sledgehammer to crack a likely insignificant nut) at a time when that investment might be better ploughed back into prices to attract former customers back and away from the likes of Aldi and Lidl.

Hi everyone. I'm new on here and not sure where to post this, so really I'm sorry if it's wrong.
I hope someone on here can help me.
On August 12th 2016 I went to Sainsburys Fosse park Leicester for petrol, after finishing my 12 hr night shift at 05.45, I got to Sainsburys at 06.01. I got my petrol and left, went home, took my hubby to work and went to bed. I got up at 12 midday, picked my hubby up at 13.00 and went to do our grocery shopping at the same Sainsburys. We got there around 13.20, had lunch in their restaurant and did our grocery shopping and left at 14.35 as I had to be ready for work for an another 12 hour shift.
On August 22nd, I received a letter for a 'fine' of £70.00 or £40.00 for early and prompt payment for an overstay of 5.7 hours! The letter was addressed to my husband, the info Euro car parks obtained from the DVLA.
I know that Sainsburys have an Automatic reg reader, because I've seen it. The problem I have is the reader only seems to man one entrance and exit into Sainsburys and depending on which direction you come in is, whether or not you pass the reader, for example, you can get to and leave Sainsburys via Pizza Hut and therefore missing the reader completely. I passed the reader as it was the only way I could get into the petrol station from my direction from work.
According to Euro car parks, I went into Sainsburys at 06.01 and left at 14.35.
How do I prove my innocence other than I was there, which I don't dispute but I went home and came back later on that day, the reader didn't clock us arriving at 13.20!?
I know a fella sometimes walks round the car park checking the cars and I feel sure the signage, which is everywhere says, after 3 hours stay, your liable to get clamped and fined. I had no windscreen ticket nor clamp, as, the car was obviously not there and I know they have cctv all over the car park.
I have my receipts with the times on for my petrol, lunch and groceries for that day but will it be enough to prove my innocence?
We are going to see the store manager and of course I shall contest the 'fine' but I'm absolutely furious, we've been loyal customers of Sainsburys Fosse Park for years always gone the same way for petrol, have passed the reader several times and sometimes one way only, due to nature of our next destination and never been issued any form of 'fine'. We have never overstayed, especially not 5.7 hours! I can't understand why now, what did I do wrong?
If anyone can help or offer an more advice, I would be very grateful and I shall keep you posted on how I get on.
