Parking fine from Parent & Child Asda Car Park by Smart Parking (PPC)

I received a parking from smart parking after parking in the parent & child spot at an Asda Car park in Bolton. After ignoring the fine due to the rumors of this organisation being legally unable to enforce the fine. I have now received an increased charge of £120 by a company called Debt Recovery Plus Ltd and my mother is getting worried that if we don't pay the fine we will be taken to court.


Can anybody clear this up for me?

    It's not a fine! Debt Recovery Plus cannot take you to court, nor can Zenith Collections who are DR+ pretending to be someone else. Smart Parking have NEVER taken anyone to court ever.

    Your choices are to completely ignore this, or pay them, but why come here if you were going to do that? Have you made complaints to asda yet, if not why not ?

    1. It's not a real fine! You can ignore it but you'll get rubbish letters for months.

    2. Complain to the Store manager in person (not to the CS desk drone). Say you feel harassed and intimidated for shopping there (show lots of receipts).

    3. Send the template appeal from the NEWBIES thread (top of the forum) online today to Smart Parking and they will very likely cancel. They don't know how to reply to that template so they don't bother, even when it's sent late. If you look at it, the template does not even talk about the bay or what happened or why!

    4. If none of the above work, email the CEO of Asda to complain.

    If your mother was with you when you parked then you have no problem.
  • As an honest individual I have to admit that I was in fact not with a child at the time but my reason for ignoring the fine was simply cos the car park was basically empty and of the rumors i previously mentioned.
    At the end of the day i was only in the shop 5 minutes and I would not of parked their if it was busy!

    I have come here as my worried mother is positive that due to a change of legislation in 2013 (i think) that we can be taken to court and she cannot allow our house to be issued a CCJ as she regularly hosts for international students as a much needed second income.

    Apologies for any unclear bits but my knowledge in this field isnt the best.

    1) ITS NOT A FINE !!!!!!!!!!!!
    2) SMART PARKING HAVE NEVER TAKEN ANYONE TO COURT!!!
    3) DEBT RECOVERY PLUS CANNOT TAKE YOU TO COURT!!!!
    4) MAKE COMPLAINTS TO ASDA

    The legislation you are referring to is Schedule 4 of the Protection of Freedoms Act 2012, we know this inside out!!

    Take receipts in for the day, or for a period of time if you have them, speak to the store manager saying you are being harassed by their agents in their car park.

    If it's a stand alone ASDA, they may try and fob you off saying its a council car park, inform them that you have already made enquiries to the council and they say it's not theirs. Also that you have proof from the land registry saying it's their car park.

    This car park, Bolton, is Asda owned. Some though genuinely are Council run.
    Eg. Elsmere Port.

    Can't happen - the Act you are referring to is the POFA 2012 which 'can' potentially hold a keeper of a car 'as liable' as a driver would be - whiich isn't usually anything that can stick at all in 99.9% of cases! But this Act applies ONLY if the parking operator follows the statutory wording of POFA 2012 in their Notice to Keeper letter.

    Guess what - Smart Parking don't bother with that statutory wording!! :)

    They will run away when Asda tell them to (ONLY speak to the Store Manager, not a Duty Manager). Or they'll cancel when they see the template appeal from the NEWBIES thread in their inbox. Usually they cancel within 10 days of receiving it! NEXT TIME SEND IT AS SOON AS THE FIRST LETTER ARRIVES.
