I am sorry if I am being thick, trying to find a thread on Divorce, can someone place this in the best forum - thank you
basically, when does a judge actually look at the facts and pull someone up for lying.
seems to me that you go to court, you go away, you come back, and so on and so on.
When the evidence shows that one party is lying, withholding information and is just allowed to walk away with it being allowed more time to come back to court and still not provide the information.

Their is no fairness in the courts, often the judge doesn't want to listen to what they thinks is tit for tat when in all honesty as in your case you are disclosing your info fairly and partner is not...the whole system is a mess and family member heading that way shortly, they are honest, other half a LIAR0 -
At the risk of sounding like an unfeeling noob:
As long as you end up divorced and financially everything is stable...isn't that the outcome you want no matter what?

I guess the question is whether it impacts the financial side or kids. If it doesn't... does it matter? How much difference does it make? If the divorce is inevitable, I would think maybe you would be best to just be pragmatic (assuming its not financial/impacting children) rather than draw out the stress/aggro/pain?0

ive divorced twice, and just filled in forms, didnt have to go to court etc, me and exes sorted it amicably. No point in it costing more than necessary. Can you not just do that?0

Based on a friend's fairly recent experience, lots of this stuff was sorted out during mediation - financial, child access etc.
They didn't even have to go to court.0 -
it isn't my divorce, and no kids involved
anyway all pretty much sorted now, but 15k to be paid over the next few years in stages and 1.5k awarded in court costs (divorce)
how do you then get the 1.5k from the person that has been told to pay, they have signed and agreed to the sum and now wants to pay £50 a month???
how do you enforce, successfully, a court order?

Was a solicitor involved?
If so, shouldn't they have discussed this with the person getting divorced?0 -
When i was divorcing, i asked about divorcing my husband for adultery. My solictors advice was not to use this reason as it complicates the process, meaning it would cost me more. Her advice was "to end the marriage as quickly and cheaply as possible"
Judges aren't usually interested in "he said" "she said"
As far as the £50 per month goes, you can't get blood out of a stone. If they don't have the money, they don't have it. You could try to force them but this would obviously involve more costs. A friend of mines ex husband spent over £40k in court costs trying to avoid paying her the £30k he owed her. He lost. Dumb or what ?0 -

Just a query did you have to wait 2 years after splitting up to do this, as looking at forms it suggests you need to be apart for at least 2 years is that correct?0 -
Technically, yes, but many couples, who just want it over, have been known to tell porkies as to how long they have been apart.
You don't have to be legally separated just need to state that you have been apart.
(Unless it has changed in the last 10 years).
