Ran out of appeal time - UKCPS

Hi all.

As it stands, I have now left it too late to appeal my parking ticket.

What can I do?

I have heard regarding sending a letter stating its the wrong address, and get them to resend a letter to your nans house for example, which restarts the appeal time limit.

Could anyone help me please and let me know what I could do?

    What you're thinking about is resetting the clock by naming the driver, thus discharging registered keeper liability. This only works properly if there was never a windscreen ticket.

    Hi, yes I have read the newbies thread.

    The part regarding my position is : "ONLY consider naming the driver for a windscreen ticket case if the registered keeper is not happy to cope with the letters and would rather they went to the driver (e.g. if an elderly relative is the keeper and is upset by all the letters, and is too late to appeal, or if the driver was your ex and you are understandably not happy to have court threats arriving addressed to you as keeper!). "

    So, I am the registered keeper and I was the driver at the time of the parking offense. It was a windscreen ticket case too.

    What can I possibly do? This is not covered in the newbies thread.

    Could I say something along the lines of the driver was my ex, that now lives at XXXXXXX and I have NOT send on the paperwork to the individual. Please stop harassing me with paper work for an offense that does not lie with myself?

    Your help is very much appreciated. I don't want to lose this case just because I was away on holiday and now its too late.

    You could submit an appeal anyway, acknowledge that it is late. I recall that there was some text for it somewhere.

    Or you can ignore it but that would depend on what parking company it is, depending how likely they are to 'do' court.

    If you're going to appeal, put this at the top of the appeal letter contained in the Newbie sticky thread:

    I am appealing the above PCN, I realise that I have missed the appeal deadline however, considering this appeal will show a willingness to enter into mediation on this matter and to mitigate your losses and will work in your favour should the matter go further. Should you reject my appeal issuing me with a POPLA/IAS code will also show your willingness to settle this matter without taking it any further.

    (Obviously amend the reference to POPLA/IAS depending on which one is relevant for the parking company involved here)

    do not lie if you were the driver and RK - as UKCPS do issue court papers - and monitor the forum - not worth the risk of perjury.



    A late appeal is a possible - though don't hold your breath that you will receive a POPLA code. Any letter should be sent with proof of purchase only - do not use recorded delivery.


    You should also be making a complaint to the retailer / landowner wherever you received this ticket. Make it forceful and demand that they instruct their car park mis managment agent to cancel this.

    Surely DA Rule - you're such an expert with your e-book you should know what to do without referring to the NEWBIE thread and copy text tut tut tut and you should know whether UKCPS are members of the BPA or IPC

    That would be fine - but he has made personal comments about me and KIFL on other people's threads... and you have no idea what is going on.



    Apologies to the OP here - if you are caught up in a little crossfire !

    Do make an formal complaint to the retailer etc as they can instruct to cancel.

    And make a formal late appeal

    Do you mean that 28 days has been and gone, since you received the 'Notice to Keeper' letter?

    Yes, the 28 days has gone. They they sent out another letter that went up to £100 within 14 days. Now I have received a final 'demand' from UKCPS stating I have 7 days to pay £125.

    I love how my latest letter has a 'typical breakdown of costs following court action'. I see how some people may crumble at this, not me :).

    Am I right in saying I just send a letter as outlined in the newbies thread?

    yes you can send the template letter at ANY TIME as outlined in the newbies thread

    if you are past the "deadline" then NO they do not have to issue you with a popla code , but can if they wish

    as for what to do about all this , yes it IS in the newbies thread (appeal anyway)

    BUT its likely that you will get these rising demands for payment , and yes they may well issue court proceedings (they have done so before)

    in which case by appealing now you are paving the way for asking the judge for it to be settled at popla as an ADR (AGAIN covered in the newbies thread)

    it also tells you in that newbies thread to complain to the landowner and get cancellation too

    so I believe it was ALL covered in the newbies thread all along

    once the appeal timeframe has lapsed , this is what you are faced with , and the RK is liable under english law due to POFA 2012 issued oct 2012 so lying about it wont help your case and can be worse than the contravention itself , so do not lie at all !

    naming another address or ex partners wont help here as its not the case

    your best bet is to appeal now to both the ppc and landowner and get it sorted if at all possible

    otherwise do so anyway so you can try for popla if you get court papers in the future
