Refund Entitlement?

I have an annual membership for a sporting venue. I paid my annual fee, which entitled me to entry to 25 events at the venue. The company have now decided to cancel the last 2 events in October in order to do some maintenance. They say they will give a discount of 2/25ths, but not until the end of the year. Then it will be either a reduction against next years membership, or if I do not renew, a cash refund.

In my opinion, as it is their decision to cancel, and members paid for 25 events in good faith, they should give a refund now. Quite a lot of money is involved, and when that is multiplied up by the number of members, the company are holding on to a considerable sum for events that will never take place.

Can anyone tell me the law on this please?

How many events are held at the venue? Are you able to attend 25 events prior to the 2 cancelled events?

25 is the total number of events in the membership year. That has been reduced to 23 through no fault of the members, who paid in good faith for being able to go to 25.

In addition, as I see it, as the company have said that they will make refunds of 2/25th, they are acknowledging that they owe all the members money. Are they entitled, therefore, to withold that refund for months and months?

I would advise that you wait until tomorrow and then seek independent legal advice regarding the law in this matter.

An open internet forum is not the place to obtain such legal advice ... not if you wish to rely upon it.

Yes, thankyou. I agree, but just wondered if anyone knew the answer. I will seek legal advice tomorrow on behalf of all the affected members.

How much money are you expecting to be refunded?
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

Yes I know it's 2/25ths but how much are we talking about?

Over £100 per member, and there are over 700 members.

At £100+ it may be worth seeking an early refund.

Although it seems an obvious question, not everything is always straightforward, but would the venue be in a financial position to refund all the monies now?

As you're seeking legal advice, would you please let us know the results of this?
