    With leasehold properties particularly, it can vary. With some, a designated parking space is part of the property (i.e. it is specified in the lease, and a plan would clearly show it). In such cases it's normally easy, even if the property is subsequently let out: tell them to f-off as they are trespassing. The management company must also be told to cease and desist in their actions to impose conditions contrary to the lease. [One needs to check the lease to ensure there's not some strange clause which allows them to.]


    When parking is shared, then it's a lot less clear. While any PPC tickets are still unenforceable (as losses are still zero), they still need to be challenged in the correct way. Being belligerent, in a similar situation, I would just collect tickets and appeal each one, costing the PPC money every time.

    So, JD are the one's issuing these things. They are probably trespassing also due to the fact that there is perhaps not a contract between whoever the Landowner is and the PPC.

    The management company being the couple on site here instructing Adair Paxton to contract a PPC, I believe.

    I will have to properly sit down and spend about a quarter of an hour speed reading through the Assured Shorthold Tenancy Agreement.

    I can see myself appealing this one at POPLA also. I will take great satisfaction in the knowledge that it will cost them £27.

    But watch they don't go ticketing your car! :rotfl:

    Okay, I've spent some time reading through the AST agreement and cannot actually find a single clause that mentions anything about parking. The introduction of permits only came in 2-3 months ago and so would this not have to be added to all tenants' lease agreements i.e. in the form of appendices?

    The Landlord is aware (email received in February from Landlord's agent) of this parking enforcement as he seemingly received notification from the managing agents that, because of car parking abuse, permits are being issued with penalties for abuse.

    I've now just sent off an email to my letting agent asking that she forward it to my Landlord to also ask if he is willing to send a "cease and desist" letter to the managing agents.
