Refund minus delivery

Options
Hi,

We purchased a sofa bed from eBay recently, and due to having recently moved it was delivered to the wrong address. Totally our fault. The sofa was returned to the seller (he wouldn't instruct the courier to deliver it to our new address as both the eBay and PayPal accounts were still under our old address)
The seller has offered us a refund, minus delivery cost. If there had been a delivery charge we would accept this of course. But delivery was stated as free. Do we have any right to demand a full refund?

Well the seller lost out through your mistake
Or do you think it was free for them?

It's like a refused delivery ... refund MUST be in full since this was an internet (distance) transaction. (Distance Selling Regulations). Seller would then need to sue you for the delivery charge.
  • No need to be rude custardy :) I was simply asking a question. Thank you for your reply :)

It might be best to ask this on the Ebay boards.

That said IMO this is fully your responsibility, you should have made it clear regarding your address and I would ask the seller for proof of shipping and minus that from the cost simply as good will because I caused the problem, not the seller.

You may not like or agree with it.
It was in no way rude though.
    Feel free to apologise.
  • Thank you bod and thank you burnley.

I agree we were at fault, hence not diving in demanding a full refund, we want to rebuy from him, just wondered where we stood as it is stated being free delivery

Sorry I didn't realise there was an eBay board. Thank you will look there now.

Burnley gave you the morally-right answer; I gave you (what I believe to be) the legally-correct answer. The way forward is now your choice. :)

Only if the seller was a business. The OP doesn't mention either way so could just as easily be a private seller.
