Im new to this forum and cant see where I can start a new thread so I apologise for highjacking this
This morning I have receivec a letter from Drydensfairfax saying they hsve been insteucted by Capquest to take conduct of the matter of an outstanding amount of £771.91 to Capital one I cannot think what this relates so Im thinking a prove it letter to them but the next paragraph is the worrying one they said on 7the April 2009 a Charging Order was granted securing the debt on behalf of their Clients. This is the first letter I have received from Drydenfairfax so Im obviously extremely worried about the mention of a CO. I have just viewed my properties entry in the Land Registry and there is no mention of this charging order infact there is nothing apart from the details of our Mortgage Could anyone please advise as to what I should do next with regard to this0 -

Is the debt in your name, have they got the wrong person ?
For a CO to be granted, it must already of been to court, and a CCJ awarded against you, and as it was granted before 1st October 2012, you must of either not paid or missed an instalment, hence why we are here now, although I can't understand why they have waited nearly 6 years to contact you ?

Also there would be a charge showing on the Land Registry entry.
If they are convinced their debt is secured then they do not need you to do anything as the debt will be cleared when you move house (they can't force a sale on this).
I'd check your credit file (a £2 statutory report is enough) and if nothing is showing there, I'd probably ignore them.
